On September 21, Khanh Hoa Provincial People's Court announced that at 8:00 a.m. on September 22, it will hold a first-instance trial of the criminal case against defendant Ngo Duy Binh (51 years old, residing in Loc Tho Ward, Nha Trang City) for the crime of "Violating regulations on road traffic participation".

The Mercedes driven by Mr. Binh caused an accident and then fled.
According to the indictment, Ngo Duy Binh, the head of the bank's transaction office, submitted a request for leave and a temporary suspension of his contract due to health reasons. On the morning of March 3, Mr. Binh went to the bank to hand over his work. At about 11:30 a.m. the same day, Ngo Duy Binh had lunch with his colleagues and drank beer. At about 4:00 p.m. the same day, due to family matters, Mr. Binh drove a brown Mercedes-Benz E200, license plate 79A-093.02, along Vo Nguyen Giap Street to Nha Trang City (direction Dien Khanh - Nha Trang).
When reaching the road section in Vo Kien village, Dien An commune, Dien Khanh district, due to lack of observation, Ngo Duy Binh let the right rearview mirror and the outside of the front door of the car collide with the left handlebar and the left rear footrest of the motorbike with license plate 79Z1-445.91 driven by Mr. Gelinas Guy (Canadian nationality), carrying his wife, Ms. Doan Thi Van Anh, and daughter, Gelinas Any, traveling in the same direction in front. The collision caused the motorbike and the person on the motorbike to fall onto the road.
When the collision occurred, hearing a noise on the right side of the car, Binh knew that the car had collided with a motorbike but did not stop but continued driving straight and left the scene. After the collision, Ms. Doan Thi Van Anh was later taken to the emergency room but died; Mr. Gelinas Guy was injured and taken to Khanh Hoa General Hospital for emergency treatment.
On March 7, Ngo Duy Binh went to the Dien Khanh District Police Department to confess his crime.
The forensic examination of the injuries determined that Mr. Gelinas Guy suffered injuries with a body injury rate of 35%; the concentration of Ethanol in his blood was 43.72 mg/100 ml.
Regarding civil matters, Ms. Doan Thi Ngoc Truc Quynh (a relative of Ms. Doan Thi Van Anh) requested compensation of 100,000 USD (equivalent to 2.3 billion VND). Ngo Duy Binh has compensated 50 million VND and agreed to compensate an additional 550 million VND, but the victim's representative has not yet accepted.

Regarding Mr. Gelinas Guy, on June 1, Dien Khanh District Police issued a decision to administratively fine him for the following violations: Driving in the wrong lane, not having a driver's license, having a blood alcohol concentration (but not exceeding 50mg/100ml) with a fine of 4.5 million VND.
As for defendant Ngo Duy Binh, he consumed beer right before driving the car and causing the accident, but because he did not appear at the police station until March 7 (4 days after the accident), his alcohol concentration could not be determined for consideration and handling according to the law.
