The Department of International Cooperation (Ministry of Education and Training) has just informed about the new points of Decree No. 124/2024/ND-CP amending and supplementing a number of articles of Decree No. 86/2018/ND-CP regulating foreign investment cooperation in the field of education.
Specifically, according to the provisions of Decree No. 124/2024/ND-CP dated October 5, 2024 of the Government amending and supplementing a number of articles of Decree No. 86/2018/ND-CP dated June 6, 2018 of the Government regulating foreign cooperation and investment in the field of education:
The proper name of a foreign-invested educational institution must be clear, transparent, and not cause misunderstanding about the organization and activities of the school; must not be the same as or confusingly similar to the name of a registered educational institution, the name of an enterprise implementing the investment project, or the name of a non-governmental organization; must not cause confusion about the class or rank of the educational institution and the content of the teaching program; must not use words or symbols that violate the historical traditions, culture, ethics, and customs of the Vietnamese people.

Decree No. 124/2024/ND-CP amends and supplements a number of regulations on subjects and training programs of training cooperation with foreign countries. Specifically, foreign higher education institutions that cooperate in training with Vietnamese higher education institutions must be prestigious and quality training institutions, licensed by competent authorities of that country to train and grant degrees in the joint field or have a valid education quality accreditation certificate issued by a legal quality accreditation organization.
At the same time, supplement regulations on the establishment of branches of foreign higher education institutions in Vietnam, contributing to selectively attracting investment from quality higher education institutions. Foreign higher education institutions investing in establishing branches in Vietnam must be legally established and operating abroad, belonging to the group of 500 higher education institutions ranked highest in the world's prestigious university rankings in one of the three most recent years. Branches of foreign higher education institutions in Vietnam are allowed to operate according to the training and accreditation standards of the foreign higher education institution that established the branch (however, the conditions on facilities and lecturer standards must not be lower than the regulations for Vietnamese educational institutions).
Decree No. 124/2024/ND-CP also adds regulations on the quality of foreign preschool and general education programs taught in Vietnam. Accordingly, foreign preschool and general education programs, if implemented in Vietnam, must be recognized or quality-assessed by competent foreign educational agencies and organizations, must be directly taught for at least 05 years abroad, and must ensure that educational objectives are consistent with Vietnam's educational objectives. Preschool and general education institutions teaching foreign educational programs must seek opinions from local state management agencies on education to manage the content and quality of foreign educational programs when implemented in Vietnam.
The People's Committees of provinces and centrally run cities, within their assigned scope and authority, are responsible for managing, inspecting, examining, and evaluating the results of cooperation and investment activities in the field of education; resolving complaints and denunciations, rewarding, and handling violations within their authority in this field at the local level. This regulation contributes to enhancing the proactive role, strengthening the management and responsibility of localities in cooperation and foreign investment in the field of education.
