It is worth mentioning that many of the products advertised and sold on TikTok shops are mostly of unknown origin, counterfeit brands... Many shop owners livestream and advertise branded products but the price is only from tens to hundreds of thousands per product.

“ Hommet slippers are only over 1 million VND, super quality goods with full receipt, bag, fabric, guys ” or “ Lui Shut Tong scarf, branded, hot sale, price only 1 million, limited quantity, hurry up before it's gone ” - these are the sweet sales words of an online sales account owner on TikTok.
In order to deceive the authorities, when livestreaming to sell goods or posting sales posts, account owners often misspelled the names of famous brands. Instead of writing Hermès, Louis Vuitton... these shop owners will abbreviate/intentionally misspell as HM, Ho met, Luon Vui Tuoi, Louis Vuituoi, Di ò... Research on TikTok Shop shows that fake Louis Vuitton brand T-shirts are sold for prices ranging from 79,000 VND to 250,000 VND. Or a watch advertised as a Rolex is sold for 217,000 VND...
Ms. Nguyen Thi Minh Huyen - Deputy Director of the Department of E-commerce and Digital Economy, Ministry of Industry and Trade said that the development of e-commerce also creates loopholes for the trading of counterfeit goods and goods of unknown origin in the market.
Strengthen control of origin and quality of goods
Assessing the issue of counterfeit goods, fake goods, and goods of unknown origin on the TikTok Shop network platform today, Director General of the General Department of Market Management Tran Huu Linh commented that, in addition to the growth momentum and positive aspects, e-commerce in general and TikTok in particular are facing many consequences when the situation of counterfeit goods trading and commercial fraud is still complicated.
Not to mention, the emergence of many new business models and methods in many different regions and industries poses significant challenges regarding the adaptability of the legal corridor.
In particular, the change in payment fee policy has helped the number of new stores registered on the platform as well as TikTok's revenue increase day by day. However, the downside of the above situation is that TikTok is gradually becoming a new "concentration point" for counterfeit and infringing goods.
" Although TikTok Shop strictly prohibits poor quality products, traders can still easily "evade" the platform's management policy. Therefore, if management is loosened and supervision of sellers and products is not increased, TikTok will become a gathering place for many types of poor quality goods, seriously affecting consumers, " said Mr. Tran Huu Linh.
In order to strictly handle and prevent counterfeit and smuggled goods to promote the development of e-commerce, as well as protect the rights of consumers in online shopping, Ms. Nguyen Thi Minh Huyen said that the Department of E-commerce and Digital Economy will continue to perform well its role as the focal point for implementing Decision No. 645/QD-TTg dated May 15, 2020 of the Prime Minister approving the master plan for national e-commerce development for the period 2021-2025.
At the same time, research, review and complete the legal policy infrastructure for e-commerce: Focus on disseminating and guiding traders, organizations and individuals related to legal regulations on e-commerce, including Decree 85/2021/ND-CP amending and supplementing Decree No. 52/2013/ND-CP and guiding circulars, enhancing connection and exchange of information and data between state management agencies as well as state management agencies with enterprises.
Many experts believe that e-commerce is just a new business method besides traditional business methods. The final problem is to control the origin of goods such as goods produced counterfeit in Vietnam or imported through border gates, or smuggled through unofficial channels?... because only when the origin is controlled, can the problem of counterfeit goods, smuggled goods, and goods of unknown origin be completely prevented.
Previously, the Ministry of Information and Communications conducted a comprehensive inspection of TikTok's operations in Vietnam. After 4 months of inspection, the Ministry's Interdisciplinary Inspection Team discovered many violations and issued inspection conclusions.
In the inspection conclusion, the Interdisciplinary Inspection Team specifically requested the Ministry of Industry and Trade to take measures to force TikTok Singapore to immediately correct violations in providing cross-border e-commerce platform services to Vietnam. Specifically, there should be solutions and tools to improve the effectiveness of anti-counterfeiting work and protect consumer rights in e-commerce in Vietnam according to regulations...
At the same time, it is recommended to have solutions to prevent and remove from the application products in the list of prohibited goods and services, in industries and professions prohibited from investment and business according to the provisions of law and have tools and measures to control by keywords and filter information by keywords before information about goods and services is displayed on the application.
