On November 19, the Provincial Civil Judgment Enforcement Agency (CEA) held a conference to collect comments on the draft Law on Civil Judgment Enforcement (amended).
The draft Law on Enforcement of Judgments (amended) maintains the structure of the current Law on Enforcement of Judgments with 9 chapters and 231 articles. Of which, 50 articles are newly created and 93 articles are amended and supplemented (accounting for 52% of the total number of current articles). Accordingly, the scope of regulation is supplemented; a number of provisions on the interpretation of terms are amended and supplemented; the principle of the enforcement agreement must not violate the prohibitions of the law, be contrary to social ethics, and affect the legitimate rights and interests of the State or third parties is added. In addition, the draft also adds a provision that the enforcement agency under the Ministry of National Defense is the enforcement agency and has the function of organizing the enforcement of judgments; adds the tasks and powers of the enforcement agency; adds the authority to organize the enforcement of judgments of the provincial-level enforcement agency and the district-level enforcement agency; amends the provisions on the procedures for applying measures to secure the temporary detention of assets and documents of the parties; Temporarily suspend registration, transfer of ownership, use, and change of property status in the direction of reducing the time limit for returning property, documents, etc.
Commenting on the draft Law on THADS (amended) is very important, aiming at the goal of ensuring consistency, effectiveness and efficiency after the Law is promulgated. In the spirit of active, urgent and responsible work, the delegates focused on analyzing and contributing many opinions to the draft content. Based on the comments, the Provincial Department of THADS will synthesize and advise the Provincial People's Committee to have a document to comment and contribute opinions on the draft Law on THADS (amended) to the Ministry of Justice according to regulations.
