The 4th time the Government submitted a draft decree to replace the petroleum business

DNVN - According to Minister of Industry and Trade Nguyen Hong Dien, the Ministry has organized 4 consultations with ministries and branches, both in written form and in direct discussions. This is also the 4th time the Ministry has submitted to the Government a draft decree amending Decrees 83, 95 and 80 with the aim of providing the most complete and suitable plan for the current situation.

According to the official dispatch issued on September 20, Deputy Prime Minister Bui Thanh Son directed: "The Ministry of Industry and Trade shall preside over and work directly with ministries and agencies such as Finance, Planning and Investment, Public Security, Justice, Home Affairs, Government Inspectorate, Vietnam Federation of Commerce and Industry, Vietnam Petroleum Association and relevant parties to review and unify the contents with different opinions of the draft Decree replacing Decree No. 83/2014/ND-CP on petroleum trading and decrees amending and supplementing Decree 83/2014/ND-CP. In addition, it is necessary to study, review and complete a number of contents related to administrative procedure reform, ensuring scientific, reasonable, feasible, meeting the requirements of practice and state management, while harmonizing the interests of the state, people and businesses; reducing administrative procedures and enhancing decentralization and delegation of power."

To implement this direction, on October 2, Minister of Industry and Trade Nguyen Hong Dien chaired a conference to discuss and reach consensus to complete the draft decree to replace the decrees on petroleum trading.

At the conference, Minister Nguyen Hong Dien emphasized that in legal documents, petroleum is identified as a strategic commodity. Along with electricity and gas, petroleum is considered the "bread" of the economy.

Petroleum is always a conditional business item according to the provisions of law. Therefore, the conditions in the draft decree not only ensure the market mechanism but also comply with the State management mechanism.

This is the fourth time the Ministry of Industry and Trade has organized to collect opinions from ministries and branches through both documents and direct meetings. At the same time, this is also the fourth time the Ministry has submitted to the Government a draft decree amending Decrees 83, 95, and 80 with the goal of perfecting the plan that best suits the current situation.

Up to now, according to the report of the Editorial Board and Editorial Team, there are still some problems although during the drafting process, the Ministry of Industry and Trade strictly followed the basic viewpoints in Resolution 55 of the Politburo on Vietnam's Energy Development Strategy to 2030, vision to 2050.

These problems are mainly related to the implementation of the petroleum business management mechanism, with the goal of both ensuring national energy security and meeting domestic market demand, and operating according to market mechanisms, ensuring fair competition, while still maintaining State control to stabilize the macro-economy and important economic indicators.

Acknowledging and accepting the opinions of the delegates, Minister Nguyen Hong Dien pledged to carefully consider and accept opinions in accordance with the Party's viewpoints and guidelines, current legal regulations, as well as the practice of petroleum business management in recent years.

“We are committed to accepting the opinions of the delegates. The drafting committee will comply with the Government's instructions, trying to design the document in a way that respects the market mechanism as much as possible and improves the effectiveness of State management,” Minister Nguyen Hong Dien affirmed.

Recently, a community of more than 150 petroleum distribution and retail businesses (collectively referred to as the group of traders) sent a petition to the Prime Minister, Deputy Prime Ministers, Ministers, and Chairman of the National Assembly's Economic Committee.

According to the group of traders, despite receiving many comments from the business community, especially extensive feedback from the press and media, the Drafting Committee has completed the draft of the 4th Decree and the Ministry of Industry and Trade submitted it to the Government on August 6, 2024.

"However, many of the basic issues that we have commented on have not been revised. If these contents continue to be maintained, it will be difficult to bring about positive changes or create efficiency in the management of the petroleum market and business operations of enterprises," the group of traders stated.

The group of traders recommends that the Prime Minister, Deputy Prime Ministers, Ministers and especially the Minister of Industry and Trade consider adjusting the draft decree towards innovating management methods and mechanisms, to ensure compliance with the current legal framework, towards building a petroleum market operating according to the principles of free, equal and fair competition.

The group also recommended that the Ministry of Industry and Trade consider establishing a petroleum trading floor as directed in Official Dispatch 5124/VPCP, and at the same time request amendments to the draft decree to allow distributors to purchase petroleum from other distributors as stipulated in Decree 95/2021.

In addition, the group proposed to remove the regulation on classifying traders and replace it with a regulation regulating all petroleum trading enterprises, with business conditions and standards based on each specific activity. They also suggested reviewing the Petroleum Price Stabilization Fund because it is ineffective and creates additional financial burdens for enterprises.

The group of traders also petitioned the Prime Minister and Deputy Prime Ministers, requesting the Ministry of Industry and Trade to direct the Drafting Committee to temporarily suspend the submission for approval of the decree and continue to collect opinions from businesses and experts for the next drafts. They also proposed to prepare a policy impact assessment report, especially from the group of traders directly affected by this revised decree.

In case the Government decides to issue a comprehensive legal document on petroleum trading, traders propose to develop a Law on Petroleum Trading to ensure the strictness and compliance of the legal system.
