According to Clause 3, Article 30 of the 2008 Road Traffic Law, drivers of two-wheeled motorcycles, three-wheeled motorcycles, and mopeds are prohibited from performing the following actions:
- Ride your bikes side-by-side.
- Driving on the part of the road intended for pedestrians and other vehicles.
- Use umbrellas, mobile phones, and audio devices, except for hearing aids.
- Using the vehicle to tow or push other vehicles or objects, or to carry and transport bulky items.
- Release both hands or ride on one wheel for two-wheeled vehicles, or on two wheels for three-wheeled vehicles.
- Other behaviors that disrupt traffic order and safety.

Furthermore, according to Clause 1, Article 31 of the 2008 Road Traffic Law, cyclists must comply with the regulations in Clause 3, Article 30 of the 2008 Road Traffic Law; passengers on bicycles participating in traffic must comply with the regulations in Clause 4, Article 30 of the 2008 Road Traffic Law.
Therefore, drivers of two-wheeled motorcycles, three-wheeled motorcycles, motorbikes, or bicycles are not allowed to use headphones while participating in traffic (except for hearing aids).
According to current regulations, there are no penalties for drivers using headphones or audio devices while driving. This means that using headphones while driving is not considered a violation of administrative law.
For automobiles, Decree 100/2019/ND-CP, amended and supplemented by Decree 123/2021/ND-CP, only imposes penalties for the act of using a mobile phone with one's hands while driving on the road.
