According to Clause 3, Article 30 of the 2008 Road Traffic Law, drivers of two-wheeled motorbikes, three-wheeled motorbikes, and motorbikes are not allowed to perform the following acts:
- Ride in a row.
- Drive on the road reserved for pedestrians and other vehicles.
- Use of umbrellas, mobile phones, audio devices, except hearing aids.
- Use the vehicle to pull, push other vehicles, other objects, carry, lift and transport bulky objects.
- Let go of both hands or ride on one wheel for a two-wheeled vehicle, on two wheels for a three-wheeled vehicle.
- Other acts that disrupt traffic order and safety.

In addition, according to Clause 1, Article 31 of the 2008 Road Traffic Law, bicycle drivers must comply with the provisions of Clause 3, Article 30 of the 2008 Road Traffic Law; people sitting on bicycles when participating in traffic must comply with the provisions of Clause 4, Article 30 of the 2008 Road Traffic Law.
Thus, drivers of two-wheeled motorbikes, three-wheeled motorbikes, motorbikes or bicycles are not allowed to use headphones while participating in traffic (except hearing aids).
Under current regulations, there are no penalties for drivers using headphones or audio devices. This means that using headphones while driving is not considered an administrative violation.
For cars, Decree 100/2019/ND-CP, amended and supplemented by Decree 123/2021/ND-CP, only penalizes the act of using a mobile phone while driving on the road.
