Minimize violations that give rise to State compensation liability

Kinhtedothi – On January 2, 2025, Permanent Vice Chairman of Hanoi People's Committee Le Hong Son signed Official Dispatch No. 01/UBND-NC on implementing key tasks of state compensation work in Hanoi in 2025.

Accordingly, the City People's Committee requests that the City's departments, branches, and sectors and the People's Committees of districts, towns, and cities proactively forecast the possibility of compensation requests arising in administrative management, litigation, and execution activities through the results of reviewing cases of handling complaints and denunciations about professional activities of departments and branches; judgments and decisions of the Court on handling administrative cases in the city, and send the forecast results to the Department of Justice so that the Department of Justice can proactively advise the City People's Committee to provide timely direction on state compensation work.

At the same time, research and contribute opinions to the draft Decree replacing Decree No. 68/2018/ND-CP dated May 15, 2018 of the Government detailing a number of articles and measures to implement the Law on State Compensation Liability and draft Circulars replacing Circulars of the Ministry of Justice on state compensation work when requested.

Receive, process records and resolve requests for state compensation according to the provisions of law when a case arises, and at the same time send documents in the process of resolving compensation and reviewing the responsibility to repay the civil servant who caused damage to the state management agency to the Department of Justice according to the provisions of the Law on State Compensation Liability and guiding documents on state compensation work to monitor and synthesize the report of the City People's Committee to send to the Ministry of Justice according to regulations.

Comply with regulations and procedures on expertise and profession to minimize violations that give rise to state compensation liability. Closely coordinate with the Department of Justice in implementing state management of state compensation work in the city according to assigned functions and tasks.

The Department of Justice organizes propaganda and dissemination of laws on State compensation responsibilities and provides training and fostering of professional skills in state compensation work according to the contents of revised, supplemented and newly issued documents on state compensation work.

Actively coordinate with the City People's Court, the City People's Procuracy, the City Civil Judgment Enforcement Department and other departments, agencies and sectors of the city in performing tasks related to state compensation. Prepare necessary conditions to participate in verifying damages and negotiating compensation for cases arising in the city...

The Department of Finance prepares necessary conditions and participates in verifying damages and negotiating compensation for incidents arising in the city. Prepares estimates of state compensation funds, allocates state compensation funds and settles state compensation funds at all three levels within the city according to regulations in Clause 4, Article 60, Clause 2, Article 61, Clause 4, Article 62, Clause 2, Article 63 of the Law on State Compensation Liability.

In addition, the City People's Committee requested the People's Court, the People's Procuracy, and the City Civil Judgment Enforcement Department to coordinate with the Department of Justice to disseminate and popularize the law on State compensation liability, train, foster, and guide professional work on State compensation, and answer questions in the application of the law on State compensation liability in the field of litigation and judgment enforcement.

At the same time, send documents in the process of compensation settlement and consideration of reimbursement responsibility to the Department of Justice according to the provisions of the Law on State Compensation Liability and documents guiding the implementation of state compensation work for the Department of Justice to monitor and synthesize the report of the City People's Committee to send to the Ministry of Justice according to regulations.

In addition, properly and fully implement regulations and procedures on expertise and profession to minimize violations that give rise to State compensation liability.
