This morning, October 29, continuing the program of the 8th Session of the 15th National Assembly, under the chairmanship of Vice Chairman of the National Assembly Nguyen Duc Hai, the National Assembly listened to the member of the National Assembly Standing Committee, Chairman of the National Assembly's Finance and Budget Committee present a report explaining, receiving and revising the draft Law on Value Added Tax (amended); National Assembly deputies discussed some new contents and different opinions of this draft law.

Participating in the discussion, delegate Ha Sy Dong had some important opinions related to the regulation of value added tax for export services and the issue of tax rates on fertilizers.

Delegate Ha Sy Dong basically agreed with the reception and explanation of the National Assembly Standing Committee on the regulation of value added tax on exported services.

The delegate said that the basic principle of increasing tax value, 0% tax value has been applied for a long time to exported goods and services, because this is a tax levied on final consumption of users. If tax is applied to exported services, businesses will have to pay tax twice: once in Vietnam and once in the importing country. This not only causes difficulties for businesses but also affects national competitiveness. Especially for the Vietnamese information technology industry, which is exporting a large number of products such as software, movies, video games, and music.

According to the delegate, not allowing 0% tax rate for exported services causes information technology enterprises to seek ways to open businesses abroad, because that will avoid being taxed twice. Therefore, delegate Ha Sy Dong agrees with continuing to apply 0% tax rate for exports as currently regulated.

Regarding the tax rate on fertilizers, delegate Ha Sy Dong commented that this is a hotly debated issue through many discussions. The draft stipulates that this item will return to the 5% value added tax rate as originally submitted by the Government.

The delegate said that if there is to be harmony between the parties, perhaps the option of transferring non-taxable items to taxable items with different tax rates and possibly stipulating a tax rate of 1%, 2% or 3% for fertilizers is more optimal.

The 5% option in the draft, although not really perfect, is probably an acceptable option when considering many aspects. According to the delegate, there have been many concerns about this, as farmers who directly use fertilizers in agricultural production will be adversely affected by this regulation. In the short term, farmers may suffer losses, but in the long term, it will be beneficial.

Explaining this issue, delegate Ha Sy Dong affirmed: in the long term, domestic fertilizers will no longer be subject to reverse protection, so domestic production will be better guaranteed. Domestic supply will be stronger, not dependent on imported fertilizers in the current world context, self-sufficiency in domestic fertilizers is very beneficial. When domestic fertilizer enterprises do well, the supply is stable, farmers will reduce the risk of disruption in the fertilizer supply chain.

On the afternoon of October 29, under the chairmanship of Party Central Committee member, Provincial Party Secretary, Head of the Provincial National Assembly Delegation Le Quang Tung, delegates discussed the draft Law on Public Investment (amended); the draft Law amending and supplementing a number of articles of the Law on Securities, the Law on Accounting, the Law on Independent Auditing, the Law on State Budget, the Law on Management and Use of Public Assets, the Law on Tax Administration and the Law on National Reserves.

Participating in the speech on the draft Law on Public Investment (amended), Deputy Head of the Provincial National Assembly Delegation Hoang Duc Thang emphasized the necessity of adjusting the law to meet practical needs.

Delegates said that the 2019 Law on Public Investment has created important new changes, helping to reduce administrative procedures, decentralize and increase autonomy for ministries, branches and localities. However, after nearly 5 years of implementation, some regulations have revealed limitations, causing difficulties in implementation, especially when experimental mechanisms and policies are permitted by the National Assembly but have not been fully legalized.

Delegates proposed amending the law to promote decentralization, delegate power, promote the responsibility of leaders, and enhance the flexibility and initiative of all levels and sectors in managing and implementing public investment plans.

Regarding the regulation on the interpretation of terms, delegate Hoang Duc Thang commented on "basic construction debt", the delegate suggested clarifying and more strictly regulating the time to determine debt, currently according to the regulations, the volume of implementation must not exceed the annual allocated capital, this leads to investors getting stuck in this problem because during the construction process, there must be technical stops to stop the project.

Regarding public investment subjects, delegates proposed removing the phrase "really necessary" in the regulation on separating compensation, support, and resettlement projects to avoid confusion and disadvantages for agencies and individuals related to project investment policy proposals.

In addition, to adjust investment programs and projects in cases of “force majeure,” delegate Thang suggested that the drafting committee should re-study and clearly define the law to create a specific legal basis. Therefore, it is recommended that the cases, bases, and grounds should be clearly defined to protect those who do the right thing and implement it correctly.

Regarding the authority of the provincial People's Committee, delegate Hoang Duc Thang proposed adding regulations for the provincial People's Council to decide on investment policies for projects under the authority of the provincial People's Council, creating unity and synchronization in the project approval process, avoiding overlap and ensuring transparency.
