Hanoi approves spending levels for legal dissemination and education

Accordingly, the expenditure level for dissemination and education of law, standards of legal access and mediation at the grassroots level:

Director of Hanoi Department of Justice Ngo Anh Tuan presented the Proposal

1. Expenditure on developing programs, projects, plans for disseminating legal education, standards for legal access and mediation at the grassroots level and communicating policies that have a major impact on society in the process of developing legal documents; documents for managing, directing, and guiding programs, projects, and plans of the Council for coordinating legal dissemination and education, the Council for assessing legal access standards, and the Steering Committee for programs, projects, and plans, including:

a) Build outline:

- Develop detailed outline: 1,200,000 VND/outline;

- Complete summary of general outline: VND 2,000,000/complete outline;

b) Drafting programs, projects and plans:

- Drafting programs, projects, plans: VND 3,000,000/program, project, plan;

- Drafting reports on receiving and summarizing opinions: VND 500,000/report; c) Organizing meetings and seminars to contribute opinions:

- Host: 200,000 VND/person/session;

- Attendees: 100,000 VND/person/session;

d) Expert advice: VND 500,000/document;

d) Approval of programs, projects and plans:

- Chairman of the Council: 200,000 VND/person/session;

- Council members, secretary: 150,000 VND/person/session;

- Invited delegates: 100,000 VND/person/session;

- Comments and criticisms of the Council: 300,000 VND/article;

- Comments from Council members: VND 200,000/article;

e) Opinions on program, project, and plan appraisal: VND 500,000/article (in cases where no Appraisal Council is established);

g) Developing management documents, instructions, guidance for programs, projects, and plans: VND 500,000/document.

2. Remuneration for legal reporters, legal propagandists, grassroots mediators, people invited to participate in disseminating and educating the law, standards for legal access and mediation at the grassroots level; guiding thematic activities of the Law Club, core groups as lecturers: Implement according to the City's regulations on the level of lecturer remuneration prescribed in Appendix 02 of Resolution No. 11/2018/NQ-HDND dated December 5, 2018 of the City People's Council stipulating a number of contents and levels of expenditure under the authority of the City People's Council. In the case of disseminating and educating the law for specific subjects as prescribed in Articles 17, 18, 19, 20, 21, 22 of the Law on Dissemination and Education of Law, they shall receive an additional 20% of the remuneration received.

3. Compile some documents on popularizing, educating the law, standards for legal access and mediation at specific facilities:

a) Legal brochures (including compilation, editing, appraisal): VND 1,500,000/completed brochure;

b) Legal advice situations (including compilation, editing, appraisal): VND 450,000/completed situation;

c) Legal stories (including compilation, editing, appraisal): VND 2,250,000/completed story;

d) Legal sketches (including compilation, editing, appraisal, and expert opinion): VND 7,500,000/completed sketch.

4. Building and maintaining the activities of the Law Club and core group:

a) Expenses for food and drink support for members attending the launching conference of the Law Club: VND 50,000/person/day (no more than 1 day);

b) Pay for drinks for participants of the Law Club and core group: VND 20,000/person/session.

5. Organizing competitions and contests for the dissemination and education of law, standards of legal access and mediation at the grassroots level:

a) Expenses for organizing stage competitions and online competitions have the following additional special expenses:

- Hiring a program host: Depending on the scale and level of the organization, the agency or unit assigned to host the competition will decide on the level of hiring a program host;

- Renting halls and equipment for stage competitions: Depending on the scale, level of organization, and location of the competition, the agency or unit assigned to host the competition will decide on the rental level of halls and equipment;

- Hire artists and actors:

Hiring artists and actors for competitions organized by the City: 450,000 VND/person/day;

Hiring artists and actors for competitions organized by departments, branches, districts, towns: 360,000 VND/person/day;

Hiring artists and actors for competitions organized by communes, wards and towns: 180,000 VND/person/day.

b) The level of prize money for competitions and competitions for the dissemination and education of law, standards of legal access, and mediation at the grassroots level: Depending on the scale and location of the competition, the competition organizer shall decide on the specific prize money level but not exceeding the maximum spending level specified in this point. Specifically as follows:

- First Prize

+ Group:

Competition organized by the City: 15,000,000 VND/prize;

Contests organized by departments, branches, districts, towns: 12,000,000 VND/prize; Contests organized by communes, wards, towns: 6,000,000 VND/prize.

+ Individual:

Competition organized by the City: 9,000,000 VND/prize;

Contests organized by departments, branches, districts, towns: 7,200,000 VND/prize;

Competition organized by commune, ward, town: 3,600,000 VND/prize.

- Second Prize

+ Group:

Competition organized by the City: 10,500,000 VND/prize;

Contests organized by departments, branches, districts, towns: VND 8,400,000/prize;

Competition organized by commune, ward, town: 4,200,000 VND/prize.

+ Individual:

Competition organized by the City: 4,500,000 VND/prize;

Contests organized by departments, branches, districts, towns: VND 3,600,000/prize;

Contest organized by commune, ward, town: 1,800,000 VND/prize.

- Third Prize

+ Group:

Competition organized by the City: 7,500,000 VND/prize;

Contests organized by departments, branches, districts, towns: 6,000,000 VND/prize;

Competition organized by commune, ward, town: 3,000,000 VND/prize.

+ Individual:

Competition organized by the City: 3,000,000 VND/prize;

Contests organized by departments, branches, districts, towns: VND 2,400,000/prize;

Competition organized by commune, ward, town: 1,200,000 VND/prize.

- Encouragement Prize

+ Group:

Competition organized by the City: 4,500,000 VND/prize;

Contests organized by departments, branches, districts, towns: VND 3,600,000/prize;

Contest organized by commune, ward, town: 1,800,000 VND/prize.

+ Individual:

Competition organized by the City: 1,500,000 VND/prize;

Contests organized by departments, branches, districts, towns: 1,200,000 VND/prize;

Competition organized by commune, ward, town: 600,000 VND/prize.

- Other Consolation Prizes

+ Competition organized by the City: 750,000 VND/prize;

+ Contests organized by departments, branches, districts, towns: 600,000 VND/prize;

+ Contest organized by commune, ward, town: 300,000 VND/prize.

6. The branch shall make statistical reports on legal dissemination and education activities, legal access standards and mediation at the grassroots level:

a) Collecting information and processing reporting data: VND 75,000/report; b) Reporting, specifically:

- City report: VND 4,500,000/report;

- Reports of departments, branches, districts, towns: 3,600,000 VND/report; - Reports of communes, wards, towns: 1,800,000 VND/report.

7. Expenditures for conducting investigations and surveys on legal dissemination and education, legal access standards and grassroots mediation: Comply with the City's regulations on expenditure levels for investigations and statistics guaranteed by the City budget in Appendix 01 of Resolution No. 22/2016/NQ-HDND dated December 8, 2016 and Appendix 02 of Resolution No. 06/2023/NQ-HDND dated July 4, 2023 of the City People's Council.

8. Expenses for mediation work at the grassroots level:

a) Remuneration for mediators (for mediators directly participating in the mediation case): VND 300,000/case. In case the case is successfully mediated according to Article 24 of the Law on Mediation at the grassroots level: VND 400,000/case;

b) Support for funeral expenses for the funeral organizer of a mediator who has an accident or risks losing his or her life while performing mediation activities at the grassroots level: 5 months of basic salary;

c) Expenses to support the activities of the mediation team (expenses for purchasing stationery, photocopying documents, drinking water for mediation team meetings): VND 150,000/mediation team/month...

The Legal Committee of the City People's Council reviewed and basically agreed with the proposal of the City People's Committee. Accordingly, the adjusted expenditure levels compared to the current expenditure levels according to the regulations in the resolutions issued by the City People's Council are consistent with the city's reality.

The estimated additional budget for implementation in 2024 for a number of specific expenditures on legal dissemination and education, legal access standards and grassroots mediation as prescribed in the Resolution after its promulgation is VND 10,448,200,000 (Ten billion, four hundred and forty-eight million, two hundred thousand VND). Specifically: City level: VND 1,458,975,000; district and town level: VND 2,602,000,000; commune level: VND 6,387,225,000.
