The Hanoi People's Committee has just reported on the drafting of the revised Law on the Capital and asked for opinions from relevant units on some contents with different opinions.
The draft Law on the Capital City mentions requiring businesses and organizations to cut off electricity and water to constructions, production and business establishments that violate the fields of land, construction, fire prevention and fighting.
Explaining the above proposal, Hanoi City said that the form of cutting off electricity and water to previously violating constructions is stated in Decree 180 guiding the implementation of a number of articles of the 2003 Construction Law.
Meanwhile, the 2014 Construction Law no longer has this provision, causing difficulties in handling violations in some localities, including Hanoi.
However, during the process of drafting the law, many opinions suggested considering the application of measures to cut off electricity and water because it affects the basic rights of citizens and unreasonably interferes in civil relations between subjects.
This also affects the lives of people who do not commit administrative violations, for example, cutting off electricity and water in apartment buildings while the violator is the investor and the residents have related interests.
Realizing that this is an important issue, related to the rights and interests of organizations, people and civil transactions, the Hanoi People's Committee requested the Standing Committee of the City Party Committee to seek opinions on this content.
Regarding illegal constructions in the land sector, a leader of Soc Son district (Hanoi) once shared that in the Dong Do lake area (Minh Tri commune), there are many constructions that violate construction order. It is worth mentioning that when the authorities discovered the illegal constructions, the homeowner still brazenly allowed construction workers to complete the project.
“One of the reasons causing difficulties for the authorities is that current regulations do not allow cutting off electricity and water without a decision to enforce the illegal construction,” said the leader of Soc Son district.
The Hanoi People's Committee is requesting the Standing Committee of the City Party Committee to consult the Politburo on 16 provisions in the draft revised Capital Law to remove many "bottlenecks" in Hanoi's development process.
As planned, the revised Law on the Capital will be submitted to the National Assembly for comments at the 6th session, late 2023.
