On January 20, regarding the inheritance dispute of Mr. Vo Van Ngoan (artist Vu Linh), Ms. Vo Thi Hong Nhung filed an appeal. In the petition, Ms. Nhung wrote: "I sincerely thank the Trial Council for being reasonable and fair, correctly assessing the content and details as objective truths of the case, relieving the injustice that our family has suffered during the past time, considering and declaring to recognize some legal rights and interests for me according to regulations. Our family really wants to stop the case so that our brother can rest in peace as the presiding judge said in the first instance trial, even though our requests have not been satisfactorily resolved. However, Hong Loan's side has recently filed an appeal as well as shared in the media. Therefore, I now have this petition to partially appeal against the first instance judgment."

The late artist Vu Linh's sister appeals

According to Ms. Hong Nhung, the court of first instance's determination that Hong Loan (daughter of the late Meritorious Artist Vu Linh) is in the first line of inheritance and is entitled to 85% of the inheritance value is incorrect. Ms. Nhung believes that Hong Loan is not a legally adopted child because the late Meritorious Artist Vu Linh did not register for adoption; the adoption papers and birth certificates issued by the People's Committee of Phu Nhuan District are not in accordance with regulations.

The first instance verdict stated that Meritorious Artist Vu Linh adopted Hong Loan in good faith and that his relationship with the head of the household was that of a "child"; everyone in the family acknowledged that the late artist adopted Ms. Loan when she was young... which is incorrect. According to Ms. Nhung, Hong Loan was brought to her mother by an acquaintance. After her mother passed away, the late Meritorious Artist Vu Linh and his entire family raised Ms. Loan. Loving and caring for Ms. Loan was a compassionate act; declaring her relationship with the head of the household as a "child" was a formality for Ms. Loan to live and study.

Hong Loan also filed an appeal, requesting the appellate court to amend the first instance judgment to not allow Ms. Hong Nhung to receive 15% of the inheritance.

In addition, Ms. Nhung said that from childhood to adulthood, Hong Loan did not fulfill her responsibilities as a child... When artist Vu Linh passed away, Ms. Nhung, her daughter, and his relatives and close friends took care of the funeral in a thoughtful and solemn manner. Hong Loan did not contribute or take care of his funeral, but only took the opportunity to complete the inheritance procedures to transfer the property.

Regarding house number 5 Doan Thi Diem, Ward 1, Phu Nhuan District, Ho Chi Minh City, Ms. Nhung said that this house was given to Hong Phuong by the late artist through a verbal contract. When the late artist passed away, he did not change his mind, so it is no longer his legacy.

Based on the above grounds, Ms. Nhung believes that Hong Loan is not the legal adopted child of artist Vu Linh and is not eligible to receive the inheritance left by the late artist. In the last years of his life, when he knew he was seriously ill, Meritorious Artist Vu Linh chose her and Hong Phuong to live with him to share and gave Hong Phuong a house to live in and a place of worship.

Ms. Hong Nhung filed a petition requesting the High People's Court in Ho Chi Minh City to amend the first instance judgment, accept her lawsuit request and reject all of Hong Loan's counterclaims.

On January 7, the Ho Chi Minh City People's Court opened the first instance trial of the inheritance dispute; requesting the cancellation of a separate decision and claiming a house for temporary residence related to the inheritance of Mr. Vo Van Ngoan (aka the late artist Vu Linh), between the plaintiff, Ms. Vo Thi Hong Nhung (younger sister of Meritorious Artist Vu Linh) and the defendant, Ms. Vo Thi Hong Loan (daughter of Meritorious Artist Vu Linh).

As a result, the panel of judges decided that Ms. Hong Nhung was entitled to 15% of the late Meritorious Artist Vu Linh's estate, while the remaining 85% belonged to Hong Loan. The estate included: land and house at 5 Doan Thi Diem, Phu Nhuan District, Ho Chi Minh City; 3,007 m2 of land in Thu Duc City (Ho Chi Minh City) and a car.

On January 17, Hong Loan and her lawyer went to the Ho Chi Minh City People's Court to file a partial appeal against the first instance verdict. According to the appeal, Hong Loan did not accept the Ho Chi Minh City People's Court's decision that Ms. Vo Thi Hong Nhung was entitled to 15% of the total value of the late artist's estate.

Hong Loan filed a petition asking the High People's Court in Ho Chi Minh City to review the appeal and amend the first instance judgment to not allow Ms. Hong Nhung to enjoy 15% of artist Vu Linh's inheritance.
