The project to renovate and upgrade National Highway 26, the section through Phuong Hoang Pass, is at risk of having to extend its progress for the second time due to the mountainous land of 3 households in Ninh Tay Commune, Ninh Hoa Town, Khanh Hoa Province.
Risk of cutting off allocated capital
Present at National Highway 26, the section from the foot of Phuong Hoang Pass (Km26) to Km30 (Ninh Tay Commune, Ninh Hoa Town), Giao Thong Newspaper reporters saw in person that the construction unit was mobilizing equipment and human resources to construct some sections. In the remaining areas, many construction sites have not been completed or have been partially dug and filled, and some sites have been fenced off by landowners across the service road to prevent vehicles and machinery from entering to construct (due to the hilly land not yet being compensated).

At Km27+400 to Km27+700, there is an empty strip of land on the left side of the route, but the construction unit cannot bring in machines to work.
This is the land area of Mr. BVN that was granted a red book in 2017 and is being used for cultivation. The local government and related units are mobilizing Mr. N to hand over the construction site for this area.
At Km28+200 to Km28+400 (left of the route) is a sharp curve, the project investor (Project Management Board 5, Ministry of Transport) has come up with a plan to adjust the route. The landowner, Mr. LVT, is planting trees and crops on an area of about 7,000m2. The People's Committee of Ninh Hoa town is directing the Ninh Tay commune government and related units to persuade Mr. T to move his assets and hand over the site to the construction unit.
Moving up to the top of the pass at Km30+200 to Km30+500, here, supplies and equipment have been gathered, on the mountain peak, a road has been dug but is blocked by forest trees.
Location at Km 28+200, the landowner has not yet handed over the land, the contractor cannot mobilize construction equipment.
"Here, the investor spent 100 million VND to support the people to agree to hand over 1,400m2 of land to the construction unit. However, during the construction process, the landowner changed his mind about handing over the land. They fenced off the unfinished road to prevent machinery from entering. Currently, the arranged materials and equipment must also wait.
In this project, from the beginning of implementation, the investor has mobilized and spent support funds to help people hand over land to the project soon. However, due to land clearance problems, the project investor has requested an extension once and arranged more capital, so it is very difficult to extend the project progress again. There is even a risk that the capital source will be gradually cut off if there is no change in land clearance," said an official of the project investor.
According to Project Management Board 5, up to now, the project has basically completed construction within the scope of the handed-over site. The estimated volume is over 173 billion VND (nearly 78%).
The section from the beginning of the route to Phuong Hoang Pass (11.4km long) was handed over by the locality in June 2023. To date, the contractor has completed the asphalt paving and is completing the traffic safety system.
At Km30+200, the construction unit was forced to stop by local residents demanding the site back.
The section on Phuong Hoang Pass (3.7km long), due to the uncleared land, the investor and contractor had to mobilize the people and construct on about 2.6km, with the remaining land at 3 alignment locations with a total length of 1.1km.
According to Project Management Board 5, the total capital allocated for the project to renovate and upgrade National Highway 26 to date is 182 billion VND. In 2022, more than 4 billion VND was allocated and 100% was disbursed. In 2023, nearly 137 billion VND was allocated and 100% was disbursed. This year, more than 41 billion VND was allocated and more than 40 billion VND was disbursed (reaching 97.5%).
Mr. Nguyen Anh Tuan, Deputy Director of Project Management Board 5, said: "On November 7, the Ministry of Transport provided additional capital for 2024 of more than 63 billion VND, expected to disburse nearly 31 billion VND, the remaining 32 billion VND will be extended to 2025.
According to the plan, the project will be completed after 450 days (from August 16, 2023). However, due to land acquisition problems, the progress is delayed. The Vietnam Road Administration has agreed to extend the project's progress until December 31, 2024. Given the current land acquisition problems, it is likely that the Project Management Board will have to continue to request an extension of the project's progress beyond 2025."
Risk of dragging project progress
It is known that the biggest problem at present is that the land clearance section through Phuong Hoang Pass has not been handed over. The contractor can only construct the sections between the three above-mentioned locations. Up to now, the People's Committee of Ninh Hoa town has not yet completed the work of preparing and approving the compensation plan because the approval of cadastral measurements and specific land prices has not been completed. The delay in legal procedures has led to a delay in site clearance, slowing down the disbursement of investment capital arranged in 2024.

Regarding the land acquisition issues at the three alignment locations, the People's Committee of Ninh Hoa town said that the town has directed Ninh Tay commune and related units to mobilize households to hand over the land and not obstruct the construction. The People's Committee of the town will soon approve specific land prices and calculate compensation for affected cases so that the contractor can carry out the construction smoothly.
Regarding the land issue, Mr. Tran Hoa Nam, Vice Chairman of Khanh Hoa Provincial People's Committee, said that Ninh Hoa Town People's Committee has approved the bid package estimate and determined specific land prices to calculate compensation when the State reclaims land at the National Highway 26 renovation and upgrading project. According to the report of Ninh Hoa Town People's Committee, it is expected that in early January 2025, a decision approving specific land prices at this project will be issued. After that, it will take about 2 months to post and approve compensation.
Contractor is constructing the route at Km28+600 QL26.
"According to the report of Ninh Hoa town, the project progress is too slow. The Provincial People's Committee has requested the locality to speed up procedures and approve specific land prices in December to serve as a basis for compensation and handover of land to the construction unit. At the same time, Ninh Hoa town People's Committee coordinates with Project Management Board 5 to continue to mobilize households to hand over land and speed up the project's construction progress," said Mr. Nam.
The project to renovate and upgrade National Highway 26 (the remaining sections have not been invested in) through Khanh Hoa province was approved by the Ministry of Transport in August 2021 and started construction on August 16, 2023. The project is managed and implemented by Project Management Board 5. The total investment capital is about 268 billion VND, of which the construction and installation value is 235 billion VND.
The project has a total route length of nearly 16km. The starting point is at Km15+350 (in Ninh Sim commune, Ninh Hoa town). The end point is at Km31+255 (administrative boundary between Khanh Hoa province and Dak Lak province). The roadbed section through the center of Ninh Sim commune remains the same as the investment; the remaining sections have a roadbed width of 12m, a road surface width of 11m, and 2 lanes for motor vehicles. Particularly the section through Phuong Hoang pass (about 5km), the roadbed width is 9m, the road surface width is 8m with 2 lanes for motor vehicles; the bridge gauge is the same as the roadbed gauge.
