Elevator locked, garbage not treated
According to the feedback from residents of Osaka Complex apartment building (Hoang Liet, Hoang Mai district, Hanoi), since July 17, the building management board, Nam Minh Hoang Company Limited (abbreviated as Nam Minh Hoang Company), has locked 5 resident elevators along with 2 garbage elevators.
According to residents, this affects traffic and environmental sanitation in the building and poses potential risks related to fire safety and human life.
Mr. Dang Thanh Tung - a resident living in Building B - Osaka Complex apartment building said that since July 17, Nam Minh Hoang company has locked 5 out of 6 elevators serving residents in Building B of this apartment building, leaving only 1 elevator in operation.
Untreated, the waste is giving off a foul smell, affecting the lives of many residents.
“ The removal of the elevator has made us, the residents, extremely upset because the elderly and children cannot climb the stairs up to dozens of floors. In particular, on the evening of the 18th, a family member had to be taken to the emergency room, but because there was no elevator, moving around was extremely difficult, ” said Mr. Tung.
In addition to cutting the ladder, Nam Minh Hoang Company also locked the garbage ladder and stopped transporting garbage from July 17. This caused garbage to fill up the lobby B of Osaka Complex, giving off a foul smell, affecting the lives of residents.
5/6 elevators at Building B of Osaka Complex apartment building were locked from July 17 to 19.
The reason for cutting off the elevator and garbage elevator, according to Mr. Doan Hoang Long, a resident living in Building A - Osaka Complex apartment building, is that the elevator's maintenance period has expired (expiry date is June 30), and the contract for maintaining the elevator for transporting household waste has also expired on July 15. The reason for not continuing the maintenance was given by Nam Minh Hoang Company as lack of funds.
“ I have paid the full 2% maintenance fee since the end of 2022, but I don't understand why Nam Minh Hoang company now says there is no fund to maintain the elevator and trash elevator, ” said Mr. B.
Osaka Complex apartment building calls for help because it has paid the maintenance fund but still has no money to maintain the equipment.
Who is responsible for operations?
Osaka Complex Apartment is invested by CT Vietnam International Joint Stock Company. However, in early 2021, Mr. Phan Anh Minh - Chairman of the Board of Directors - General Director - Legal Representative was prosecuted by the Investigation Agency (Hanoi City Police) for "Fraudulent appropriation of property" and is serving a prison sentence.
Since then, residents of Osaka Complex have been left "ownerless" and unable to hold the first condominium conference due to the lack of a representative from the investor.
Speaking with VTC News reporters, a representative of Hoang Liet Ward said that the ward has contacted the investor many times to request coordination in sending people to attend the first apartment building conference, but so far no one has taken responsibility as a representative of CT Vietnam International Joint Stock Company to attend.
This leader also said that up to now, there are 5 authorization papers from CT Vietnam International Joint Stock Company for 5 different people.
" Currently, the headquarters of CT Vietnam International Joint Stock Company is located at the Osaka Complex apartment building, however the office block is not operating. The ward is investigating and if necessary, will go to the place where Mr. Phan Anh Minh is serving his prison sentence to ask about the authorization to hold the apartment building conference ," the leader of Hoang Liet ward shared.
Regarding the future handling, the ward leader said that the ward People's Committee proposed that the Hoang Mai District People's Committee and the Hanoi Department of Construction consider and guide the organization of the first apartment building conference to establish a management board, thereby solving problems related to the management, operation and maintenance of apartment buildings when investors do not cooperate.
According to Lawyer Truong Anh Tuan, when the legal representative of a joint stock company is arrested, the owner or the board of members or the board of directors will hold a meeting to elect another person as the legal representative of the company, so the company is still responsible for customers who have purchased apartments.
In the working minutes of the Hoang Mai District People's Committee on July 19, the representative of Nam Minh Hoang Company stated that Nam Minh Hoang is only a cooperative unit, CT Vietnam International Joint Stock Company is the investor. The maintenance advance payment is the responsibility of CT Vietnam Company, not Nam Minh Hoang Company.
However, the District Urban Management Office affirmed that before the management board is established, the investor is responsible for management and operation. According to the investment cooperation contract, Nam Minh Hoang Company is responsible for management and operation before handing over to the investor.
According to Decree 30/2021, when the maintenance fund has not been handed over to the management board, the investor must pay for maintenance in advance. Therefore, Nam Minh Hoang Company is responsible for maintaining the elevators.
“ Nam Minh Hoang is requested to restore the service immediately after the meeting. In case Nam Minh Hoang fails to do so, the government will intervene to ensure the interests of residents, ” emphasized the representative of the urban management office of Hoang Mai district.
Recently, on July 18, Mr. Nguyen Tu Hai - Vice Chairman of Hoang Liet Ward People's Committee - issued a document on ensuring the operation of this apartment building. The leader of the Ward People's Committee requested Nam Minh Hoang Company to ensure the operation of 12 elevators in the building and 2 garbage elevators.
Osaka Complex Apartment is invested by CT Vietnam International Joint Stock Company. During the project implementation process, the investor cooperated with Nam Minh Hoang Company Limited to implement.
Osaka Complex has 2 buildings with a total of more than 700 households living. Up to now, more than 90% of the apartments have paid the maintenance fee and the amount in the above account is 13 billion VND. Currently, this fund is still intact and has no costs, but there is bank interest.
