At noon on January 19, the People's Court of Da Nang City concluded the first-instance trial of the case of businessman Dao Nguyen Nghi who fraudulently rented a luxury Mercedes car and then mortgaged it to get money to pay off debt.
The People's Court sentenced Dao Nguyen Nghi (42 years old, residing in Group 27, Hoa Khanh Nam Ward, Lien Chieu District, Da Nang City) to 12 years in prison for fraud and property appropriation.
According to the indictment, in September 2022, Nghi asked to rent a car from Toan Cau Vang Trading and Service Company Limited (Thanh Khe District).
This company delivered to Nghi a Mercedes car with license plate 43A-486.52 of Ms. Pham Le Phuong Tram (40 years old, living on Huy Can Street, Hai Chau District, Da Nang City).
Sentenced to 12 years in prison
Then, Nghi mortgaged the car to Ms. Pham Thi Ngoc Anh (56 years old, residing in Nguyen Truc, Son Tra District, Da Nang City) to borrow 700 million VND to complete the bank's maturity procedures.
Nghi lied that the person whose name was on the car (Pham Le Phuong Tram) was his wife. When Ms. Anh asked Nghi's wife to come with her to receive the money, Nghi lied that his wife was busy and couldn't come, but gave her a paper confirming that he borrowed the money.
Ms. Anh transferred 693 million VND to Nghi. Nghi used it to pay off the debt of Mr. Tran Van Cuc (49 years old, residing in Ha Huy Tap, Thanh Khe District) 502 million VND, to pay off the debt of Mr. Nguyen Quoc Trung Tien (unknown background) 100 million VND, and spent the rest.
When Ms. Anh demanded the debt and the above company discovered that the car was mortgaged, Nghi agreed to ask Ms. Anh to return the car to the company, promising to pay the debt to Ms. Anh but did not do so.
According to valuation, car BS 43A-486.52 is worth more than 1.6 billion VND.
As Thanh Nien reported, in addition to the above case, Dao Nguyen Nghi was also prosecuted with his accomplice Nguyen Thai Dien (40 years old, residing in Hai Chau 1 Ward, Hai Chau District) in another case of fraud and property appropriation.
Nghi and Dien sold shares of Central Warehouse Joint Stock Company (of which Dien was the director) in the form of multi-level marketing to raise capital of about 40 billion VND, defrauding more than 500 people.
The two set up the Fumart supermarket chain, the website "Fumart.vn" and the app "Fumart" to deceive investors.
After raising capital, Nghi and Dien used the money to pay multi-level commissions, organize events, and advertise to continue attracting investors. Currently, Da Nang City Police continue to investigate this case.
