Bird's nest business issues invoices worth up to 34,600 billion VND without violating

Regarding the issue of Hubnest Bird's Nest Company Limited (Hubnest Bird's Nest) issuing 6 invoices worth more than 34,600 billion VND, the Ho Chi Minh City Tax Department has verified the information.

According to the Ho Chi Minh City Tax Department, Hubnest Bird's Nest Company Limited did not violate invoices.

Document results provided by Ho Chi Minh City Securities Corporation (HSC) show that on October 18, 2022, Hubnest Bird's Nest opened a securities trading account at HSC.

From the time of opening the account until March 31, 2023, Hubnest Bird's Nest transferred 339,955 derivative securities contracts of codes VN30F2210, VN30F2211, VN30F2212, VN30F2301, VN30F2302, VN30F2303, VN30F2304 with a difference in selling value and buying value of more than 14.2 billion VND.

Due to the characteristics of buying and selling derivative securities through the stock exchange, the buyer and seller do not have information, so when creating 6 electronic invoices, Hubnest Bird's Nest Company Limited wrote on the invoice "Customer does not take invoice" and did not write the buyer's tax code.

The Ho Chi Minh City Tax Department said these invoices recorded the transfer of 339,955 derivative securities contracts from October 2022 to March 2023, in a form that is not subject to value-added tax (VAT).

With the documents provided by HSC, the Ho Chi Minh City Tax Department found that Hubnest Bird's Nest issued the above 6 electronic invoices in accordance with regulations on invoices and documents. Specifically, the company has prepared and submitted a declaration of revenue from the transfer of derivative securities that are not subject to value added tax in accordance with the law.

The leader of the Ho Chi Minh City Tax Department said that although Hubnest Bird's Nest did not violate the invoice regulations, because the declaration of transferring derivative securities had a large value, the tax authority put the enterprise under close and regular supervision.

In addition, the Ho Chi Minh City Tax Department has reported to its superiors and proposed to amend and supplement Decree No. 123/2020/ND-CP in the direction of: regulating the transfer of derivative securities through the trading floor of securities companies without having to issue electronic invoices; amending and supplementing Circular 80/2021/TT-BTC in the direction of: not declaring revenue from the transfer of derivative securities through the trading floor of securities companies in the index of goods and services sold not subject to value added tax.

Hubnest Bird's Nest Company Limited was established under the business registration certificate No. 0317512399 issued by the Business Registration Office under the Department of Planning and Investment of Ho Chi Minh City for the first time on October 11, 2022.
