What support do small and medium-sized enterprises owned by women and employing many female workers receive?

At the seminar "Supporting legal advice for small and medium-sized enterprises owned by women", Lawyer Nguyen Thi Thu Thuy (Chau Phong Law Firm, Hanoi Bar Association) shared a number of special policies and regulations to support the group of small and medium-sized enterprises owned by women and enterprises employing many female workers.

Currently, the team of female small and medium-sized enterprise owners plays an important role in economic development, creating jobs for tens of thousands of workers in our country. To promote the potential, strengths and support the development of women-owned enterprises, the Law on Support for Small and Medium-sized Enterprises, issued by the National Assembly in June 2017, clearly states the Law's support principle as "In cases where many small and medium-sized enterprises meet the support conditions prescribed by this Law, priority will be given to small and medium-sized enterprises owned by women and small and medium-sized enterprises employing more female workers".

Lawyer Nguyen Thi Thu Thuy said that in order for female entrepreneurs to know whether they are in the priority support group or not, first of all, it is necessary to determine what constitutes a small and medium-sized enterprise owned by women or employing many female workers .

According to Clause 1, Article 3 of the Law on Support for Small and Medium Enterprises 2017, small and medium enterprises owned by women are identified through the following 2 criteria: Being a small and medium enterprise; The charter capital ownership ratio in the enterprise of one or more women is 51% or more, of which at least one person is the manager and operator of that enterprise.

Pursuant to Clause 8, Article 3 of Decree 80/2021/ND-CP, small and medium-sized enterprises employing many female workers are identified through the following 2 criteria: Being a small and medium-sized enterprise; Ratio of female workers: in the case of an enterprise employing less than 100 workers: the number of female workers accounts for 50% or more of the total number of workers; or in the case of an enterprise employing 100 workers or more: the number of female workers accounts for 30% or more of the total number of workers.

Support policies for small and medium-sized enterprises owned by women or employing many female workers

Lawyer Nguyen Thi Thu Thuy said that in addition to the support policies for normal small and medium enterprises (SMEs), based on Articles 4, 13 and 14 of Decree 80/2021/ND-CP, SMEs owned by women or SMEs employing many female workers are also entitled to the following support policies:

Priority support principles

When the agency or organization supporting SMEs decides on the number of enterprises eligible to receive support, the following principles must be ensured: SMEs that submit their applications first will receive support first; SMEs owned by women, SMEs that employ many female workers, and SMEs that are social enterprises will receive support first.

Thus, when businesses submit applications for support at the same time, SMEs owned by women and SMEs employing many female workers will be given priority for support.

Specific support

The Law on Support for Small and Medium Enterprises, issued by the National Assembly in June 2017, clearly states the Law's support principle as "In cases where many small and medium enterprises meet the support conditions prescribed by this Law, priority will be given to small and medium enterprises owned by women and small and medium enterprises employing more female workers";

To specify this principle, Decree 80/2021/ND-CP detailing and guiding the implementation of a number of articles of the Law on Support for Small and Medium Enterprises has a number of preferential support policies such as:

- Clause 2, Article 13 of the Decree, regarding the content of consulting support " Support 100% of the consulting contract value but not exceeding 50 million VND/year/enterprise for micro-enterprises or not exceeding 70 million VND/year/enterprise for micro-enterprises owned by women, micro-enterprises employing many female workers;

- Support up to 50% of the consulting contract value but not more than 100 million VND/year/enterprise for small enterprises or not more than 150 million VND/year/enterprise for small enterprises owned by women, small enterprises employing many female workers;

- Support up to 30% of the consulting contract value but not more than 150 million VND/year/enterprise for medium-sized enterprises or not more than 200 million VND/year/enterprise for medium-sized enterprises owned by women, medium-sized enterprises employing many female workers".

- The content of supporting human resource development for small and medium enterprises in Article 14 of the Decree stipulates: " Exemption of tuition fees for students of small and medium enterprises owned by women, small and medium enterprises employing many female workers; Support 100% of the total cost of a training course at small and medium enterprises owned by women, small and medium enterprises employing many female workers".

- In addition, Article 11 of this Decree also provides technology support for small and medium-sized enterprises, regardless of gender " Support up to 50% of the value of digital transformation solution consulting contracts for enterprises on business processes, management processes, production processes, technology processes and business model conversion, but not exceeding 50 million VND/contract/year for small enterprises and not exceeding 100 million VND/contract/year for medium-sized enterprises;

Women-owned SMEs and SMEs employing a large number of women are supported with direct training in business start-up and business management.

- Support up to 50% of the cost for businesses to rent or purchase digital transformation solutions to automate and improve the efficiency of business processes, management processes, production processes, technological processes in businesses and convert business models, but not exceeding 20 million VND/year for micro-enterprises; Not exceeding 50 million VND/year for small enterprises and not exceeding 100 million VND/year for medium enterprises;

- Support up to 50% of the value of the contract for consulting on establishing intellectual property rights ; consulting on management and development of products and services protected by intellectual property rights of enterprises but not exceeding 100 million VND/contract/year/enterprise;

- Support up to 50% of the value of technology transfer consulting contracts suitable for businesses but not exceeding 100 million VND/contract/year/business.

In addition, businesses are also supported with direct training on business start-up and business administration . Specifically, in addition to being supported with 100% of the total cost of a training course on business start-up; SMEs owned by women and SMEs employing many female workers are also supported with free tuition for students when participating in business administration training courses.

With the content of direct training support at SMEs in the field of production and processing , SMEs owned by women, SMEs employing many female workers are supported with 100% of the total cost of a training course at the enterprise but not more than 01 course/year/enterprise.

These are practical and meaningful support policies and regulations that women-owned SMEs and SMEs employing many female workers should take advantage of to operate and develop their businesses effectively.

Criteria for identifying small and medium enterprises

Currently, the criteria for determining small and medium enterprises are guided in Decree 80/2021/ND-CP as follows:

(1) Micro-enterprises in the fields of agriculture, forestry, fishery; industry and construction using an average of no more than 10 employees participating in social insurance per year and total revenue of the year not exceeding 3 billion VND or total capital of the year not exceeding 3 billion VND.

Micro-enterprises in the trade and service sector employ no more than 10 employees participating in social insurance per year on average, and have a total annual revenue of no more than VND 10 billion or a total annual capital of no more than VND 3 billion.

(2) Small enterprises in the fields of agriculture, forestry, fishery; industry and construction using an average of no more than 100 employees participating in social insurance per year and total annual revenue not exceeding VND 50 billion or total annual capital not exceeding VND 20 billion, but are not micro-enterprises as prescribed in section (1).

Small enterprises in the trade and service sector employ no more than 50 people participating in social insurance on average per year and have a total annual revenue of no more than VND 100 billion or a total annual capital of no more than VND 50 billion, but are not micro-enterprises as prescribed in section (1).

(3) Medium-sized enterprises in the fields of agriculture, forestry, fishery; industry and construction employing an average of no more than 200 employees participating in social insurance per year and with a total annual revenue of no more than VND 200 billion or a total annual capital of no more than VND 100 billion, but not being micro-enterprises or small enterprises as prescribed in sections (1) and (2).

Medium-sized enterprises in the trade and service sector employ no more than 100 employees participating in social insurance on average per year and have a total annual revenue of no more than VND 300 billion or a total annual capital of no more than VND 100 billion, but are not micro-enterprises or small enterprises as prescribed in items (1) and (2).
