WARD HEADQUARTERS IN KINDERGARTEN
At the end of Nguyen Co Thach Street inside the Thu Thiem New Urban Area, there is a small signboard showing the way to the headquarters of the People's Committee of An Loi Dong Ward (Thu Duc City, Ho Chi Minh City). Looking at the row of level 4 houses surrounded by a plot of land full of overgrown trees and grass, few people would think that this is the headquarters of an administrative agency because of the dilapidated facilities, especially when it is so different from the row of townhouses and villas a few hundred meters away.
The ward headquarters, which was originally an old kindergarten that was demolished during the implementation of the Thu Thiem New Urban Area project, was renovated for temporary use. The ward military command also temporarily arranged inside, while the ward police headquarters is located on the bank of the Saigon River. Despite being known as the ward with the most expensive real estate prices in Thu Duc City, the ward headquarters is low-lying and often flooded during heavy rains or high tides.

Many years ago, Dai Quang Minh Real Estate Investment Joint Stock Company expressed its intention to build and donate the headquarters of the People's Committee of An Loi Dong Ward so that officials and civil servants could have a more spacious workplace. However, in a recent working session, Mr. Hoang Tung, Chairman of the People's Committee of Thu Duc City, said that the cumbersome procedures have prevented the project from being implemented. The reason is that the enterprise wants to donate the project in the form of "turnkey", meaning that the enterprise directly invests in construction on the land managed by the state, not by donating cash.
Thu Duc City People's Committee has organized many direct working sessions with the departments of Construction, Natural Resources and Environment, Planning and Investment, and Finance, but the parties are still confused and have not found an optimal solution. If following current regulations, the sponsor must carry out 6 steps, such as preparing an investment project and submitting it to the Department of Planning and Investment for appraisal, preparing land allocation procedures and submitting it to the Department of Natural Resources and Environment, submitting the design drawings to the Department of Construction for approval and granting a construction permit before organizing construction.
In this process, to obtain a construction permit, the state must allocate land to the sponsor (the land allocation period is the project implementation period). Mr. Hoang Tung said that the land allocation procedures will be lengthy and complicated, especially when allocating land directly managed by the state to enterprises in the current context. Complicated and lengthy procedures will affect the interest and not attract funding sources from enterprises in the area.
If we cannot accept the donated project from a business just because of procedural issues, it is also a form of wasting resources.
SHORTENING PROCEDURES, COMPLETED IN 2024
In Thu Duc City, in addition to the An Loi Dong Ward People's Committee headquarters that Dai Quang Minh Real Estate Investment Joint Stock Company intends to build and donate, Him Lam Real Estate Trading Joint Stock Company also wants to donate a solid waste transfer station in Long Truong Ward and Saigon Sports City Company Limited wants to donate a middle school in An Phu Ward. The total cost of building these three projects is more than 200 billion VND. The locality needs it, the sponsor is willing to invest, but the procedures have not been cleared, so the project is still only on paper.
Talking to Thanh Nien reporters, many experts and delegates of the Ho Chi Minh City People's Council said that if the procedures are stuck and the project cannot be accepted, it is also a form of wasting resources. In the context of limited budget, the state is trying to mobilize resources to call for investment, but now the enterprise donates assets but the government does not receive them. The leader of the Ho Chi Minh City People's Council's Legal Committee said that it is necessary to create favorable conditions for enterprises to build, the locality only needs to closely monitor the quality of the project, ensuring safety and effective use.
To resolve the above problems, Thu Duc City People's Committee proposed a new plan with a shortened process of 4 steps. Specifically, based on the sponsor's proposal, Thu Duc City People's Committee decided to accept the product proposal in the form of public works, serving the community in a "turnkey" manner. After that, the investor prepares the project and submits it to the construction professional agency for appraisal, Thu Duc City People's Committee approves the project, then the investor makes the construction design drawings and organizes the construction. After the project is completed and accepted, it is handed over to the local government and procedures are carried out to establish public property.
With the above process, the time to complete the procedures is 135 days, not including the construction time. In addition, the authority to handle the dossier is shortened to only the Department of Construction and the People's Committee of Thu Duc City instead of having to go through 4-5 agencies as before.
Regarding this issue, Chairman of Ho Chi Minh City People's Committee Phan Van Mai assigned the Department of Construction to preside over and coordinate with Thu Duc City People's Committee, Department of Finance, Department of Planning and Investment and Department of Natural Resources and Environment to urgently study Thu Duc City's proposal, report to Ho Chi Minh City People's Committee on the acceptance plan and completion plan to put the above works into use by the end of 2024.
Public-private partnership may be applied.
Director of the Ho Chi Minh City Department of Finance Le Duy Minh said that receiving movable assets such as machinery, equipment or vehicles from businesses or organizations is very easy to handle. However, donating offices on public land is still a problem because among the five forms of recording state ownership of assets, this form is not included.
Therefore, Mr. Minh suggested that it could be implemented in the form of public-private partnership, after completing the project, the enterprise would transfer and at the same time donate to the state the assets under their exploitation rights. The Director of the Department of Finance assessed that this was the fastest method, because if the sponsorship money was received, it would have to be included in the budget, and Thu Duc City would have to request the project according to the Public Investment Law.
If it is too difficult, switch to public investment.
According to a leader of the Thu Duc City Party Committee, he himself feels impatient because the coordination to resolve the problem has taken too long, while businesses have raised the issue of funding since before Thu Duc City was established, An Loi Dong Ward was still part of the old District 2. Because the ward headquarters is temporarily arranged, it affects the working space as well as the psychology of officials and civil servants. Currently, there are nearly 30 officials and civil servants working at the ward, not to mention the military command. This person requested that departments and branches quickly resolve the problem for early implementation. In case it is too difficult and the optimal solution has not been found, then switch to the form of public investment, register capital and then follow the regulations to know the completion time.
