Enterprises are self-demolishing illegal constructions at Hai Duong Traditional Medicine Hospital

Dai Son One Member Co., Ltd. is voluntarily demolishing a series of illegal constructions on the land of Hai Duong Province Traditional Medicine Hospital.

On December 15, according to the reporter of Giao Thong Newspaper, the investor of the illegal construction cluster on the land of Hai Duong Traditional Medicine Hospital (in Hai Tan ward, Hai Duong city, Hai Duong province) mobilized workers, moved furniture, and dismantled illegal construction items.

According to residents of Hai Tan ward, some workers have been dismantling the roof and moving furniture out of the above-mentioned illegal construction cluster for the past 2 days.

It is known that this move by Dai Son One Member Co., Ltd. (the investor of the violating construction cluster) was carried out quickly after the direction of Hai Duong Provincial People's Committee Chairman Le Ngoc Chau requiring the investor to complete the dismantling of the violating construction cluster before December 31.

According to the representative of the Hai Duong City People's Committee, the city has assigned the Urban Management Rules Inspection Team to preside over and coordinate with the Hai Tan Ward People's Committee and related units to urge and supervise the demolition of this enterprise's illegal construction.

Previously, at the end of March, the People's Committee of Hai Duong province requested the Department of Natural Resources and Environment (TN&MT) of this province to advise on the proposal of Dai Son One Member Co., Ltd. to donate to Hai Duong Traditional Medicine Hospital all assets, which are illegal constructions that the company built on the hospital's land area.

After receiving instructions from the Chairman of Hai Duong Provincial People's Committee, Dai Son One Member Co., Ltd. is self-demolishing the illegal construction.

Hai Duong Department of Natural Resources and Environment has sent an official dispatch requesting relevant departments and branches to give their opinions on Dai Son Company's proposal.

In the response document, Hai Duong Traditional Medicine Hospital and Hai Duong Department of Health agreed to receive the property to serve medical examination and treatment.

The Department of Transport and the Department of Finance have not yet expressed specific opinions. However, the Department of Finance cited Decree 29/2018/ND-CP, stating that Hai Duong Traditional Medicine Hospital "is responsible for determining the appropriateness of receiving transferred assets based on legal regulations and must be responsible for that determination".

The Department of Justice and the Department of Planning and Investment clearly affirmed the view that "received assets must be legal assets".

On the side of the Department of Construction, the Provincial Inspectorate also has the opinion of not accepting the proposal of Dai Son One Member Co., Ltd., requesting the urgent dismantling of the violating construction, ensuring strict implementation of legal regulations and instructions of the Provincial Party Committee and Provincial People's Committee.

According to the viewpoint of the Department of Natural Resources and Environment of Hai Duong, based on current legal regulations and opinions of departments and branches, the Department finds that the content proposed by Dai Son One Member Co., Ltd. does not ensure legal basis and is not consistent with the instructions of the Provincial Party Committee and Provincial People's Committee.

The Chairman of Hai Duong Provincial People's Committee requested the investor to complete the dismantling of the illegal construction cluster before December 31.

From there, the Department of Natural Resources and Environment requested the Provincial People's Committee not to accept the proposal of Dai Son Company, and requested the Hai Duong City People's Committee to urgently direct the dismantling of illegal constructions on the land of the Traditional Medicine Hospital.

Recently, the People's Committee of Hai Duong province issued a directive not to accept the above-mentioned violating construction according to the donation proposal of Dai Son One Member Co., Ltd.

Accordingly, the Chairman of the People's Committee of Hai Duong province also directed units to focus on thoroughly handling violations at the Hai Duong Provincial Traditional Medicine Hospital in accordance with legal regulations, to be completed before January 15, 2025.
