The Ministry of Industry and Trade has just sent the Government a draft decree regulating policies to encourage self-produced and self-consumed rooftop solar power after consulting with Government members.
The Decree continues to stipulate the encouragement of the development of self-produced and self-consumed solar power installed on the roofs of construction works including houses, offices, industrial parks, industrial clusters, export processing zones, high-tech zones, economic zones, production facilities, and business establishments invested and built in accordance with the law.
Installations under 1,000kW only require notification
The sole buyer of surplus electricity is Vietnam Electricity (EVN) or its authorized member units. Taking advantage of rooftop solar power development to sell electricity to organizations or individuals other than those specified is considered a violation of regulations.
Accordingly, the latest draft continues to propose two forms of development. Including self-produced, self-consumed rooftop solar power without connection to the national power system. With this form, individuals and organizations do not have to register but only need to notify with design documents to the local Department of Industry and Trade; construction management agencies, fire prevention and fighting; local power units.
Rooftop solar power connected to the national power grid must be registered according to regulations. Organizations and individuals can choose to generate or not generate surplus electricity to the national power grid.
Systems with installed capacity of 100kW or more must be responsible for negotiating and reaching an agreement with the buyer of surplus electricity and the equipment, connection means and collection, monitoring and control systems to ensure safe operation.
Households and individual houses that develop this power source with a capacity of less than 100kW can develop it without limit.
Before installing rooftop solar power with a capacity of less than 1,000kW, organizations and individuals must notify the Department of Industry and Trade to monitor the development scale, state management agencies on construction, fire prevention and fighting, and local electricity.
Selling electricity to the system not exceeding 20% of capacity
Regarding incentive policies, the draft proposes a mechanism for systems not connected to the national grid, which are given priority for unlimited capacity development and are exempted from electricity operating licenses.
For systems connected to the grid, the competent authority must issue a registration certificate. This type of system, when installed, must have a system of equipment to prevent reverse current generation into the system, and is given priority for unlimited capacity development.
Organizations installing systems with a capacity of 1MW or more and choosing to sell electricity privately must carry out procedures to request a power operation license. Other cases are exempted.
For systems with a capacity of less than 100kW and connected to the power system, if not fully used, electricity can be sold to the national power system, but not more than 20% of the actual installed capacity. The price for buying and selling surplus electricity will be equal to the average market electricity price in the previous year announced by the power system operator and the electricity market.
Cases where the rooftop solar power development registration certificate is revoked are when the capacity and construction with rooftop solar power installation must be cleared. The organization or individual does not continue to develop and operate or falsifies documents in the registration file. If after 60 days of being licensed but the installation is not completed, the license will also be revoked.
