Kinhtedothi - Mr. Tran Van Luong rented 30,000 square meters of land and invested tens of billions of VND to build an ornamental garden following a multi-purpose land use model. However, this construction is facing obstacles.
Beautify the wasteland
Mr. Tran Van Luong (residing in District 12, Ho Chi Minh City) shared that implementing the Party and State's policies on economic development, especially investment and business development in the private sector; with special affection for the "Pearl Island" Phu Quoc, he has researched and realized the potential and advantages of the locality in developing eco-tourism and especially check-in points for young people.
After surveying the terrain and carefully learning about the types of check-in services for young people, Mr. Luong borrowed investment capital to rent 42 plots of land (about 3 hectares) in Dien Tien hill area (Duong Dong ward, Phu Quoc city, Kien Giang), to invest in tourism business.
“The entire land area mentioned above is owned by Mr. Le Trong Dai, including 42 adjacent plots of land, of which 300 square meters is urban land, the rest is agricultural land, there is no forest land, all are planned as urban land,” said Mr. Luong.
To realize the above idea, Mr. Luong invested effort and money to build items such as: Artistic welcome gate, photo bridge, temporary houses made of bamboo and thatch (bungalows) for display and a harmonious natural landscape system. The works are all built with lightweight materials, can be dismantled and do not affect the soil quality. In particular, the soil is reinforced by stacking natural stones to create anti-landslide slopes, both protecting the environment and improving the landscape.
These projects are not simply business items but also works of art, the passion of Mr. Luong and many other artisans. This is considered a miniature “paradise garden”, a unique product that both carries the fairy tale of Vietnamese culture and combines with a modern European-style space, creating a strong impression on visitors.
Need for objective, comprehensive assessment
Mr. Luong said that when his garden was almost completed and ready to be put into operation, he encountered legal problems. The local authorities said that he built illegally and used the land for the wrong purpose, destroying the land because the land only had 300 square meters of residential land, the rest was agricultural land and was part of the planning of the Dien Tien Hill Residential and Tourism Project invested by Ngoi Sao Duong Dong Company Limited.
On December 17, 2024, the Office of the People's Committee of Phu Quoc City announced the conclusion of Nguyen Le Toan, Vice Chairman of the People's Committee of Phu Quoc City, on reviewing the administrative violation handling records at the land of Mr. Le Trong Dai (the land that Mr. Luong rented as a garden - PV).
Accordingly, the Vice Chairman of Phu Quoc City People's Committee requested to establish a file to handle violations regarding the investment in building a garden on the land for perennial crops of Mr. Le Trong Dai; reviewing the previous file, Phu Quoc City Police concluded that there was no basis to prosecute the conversion of land use purpose of Mr. Le Trong Dai (building a house on land for perennial crops).
“Through the research process, I learned that this project has been “suspended” for many years, not implemented. Meanwhile, land users with the desire to do honest business and make practical contributions to society are not allowed to use it, the land is abandoned, a painful waste. In addition, I learned that according to the provisions of Clause 1, Article 99 of Decree 102/2024/ND-CP of the Government guiding the implementation of the 2024 Land Law, land users are allowed to use land for multiple purposes. In addition to using it for housing and planting perennial trees, they are also allowed to use it for business services but not exceeding 50% of the total area,” Mr. Luong shared.
Mr. Luong added that he has prepared a multi-purpose land use plan and sent it to the Phu Quoc City Party Committee and People's Committee for permission to use the land for multi-purposes. The garden will be invested in planting flowers, ornamental plants and other plants with high economic value.
“All the investment projects to build the garden are mentioned in my multi-purpose land use plan, increasing the land use value, there is no land destruction here. I have also sent them to the local authorities. Even during the investment process of building the garden, I regularly sent land use reports to the People's Committee of Duong Dong Ward and the People's Committee of Phu Quoc City.
On August 12, 2024, the Phu Quoc City Party Committee Office sent a document to the Standing Committee of the City People's Committee conveying the direction of the City Party Committee Secretary. It included the content of assigning the Standing Committee of the City People's Committee to consider and resolve the matter according to its authority and respond to the parties concerned. At the same time, the results were reported to the Standing Committee of the City Party Committee. Up to now, I have not received any response," said Mr. Luong.
With the construction project creating a tourist check-in point that attracts visitors to the Pearl Island, the local government and relevant agencies need to objectively and comprehensively consider Mr. Luong's proposals. From here, find a reasonable solution for the check-in garden to operate in accordance with the law, both to prevent waste of abandoned land and to stimulate tourism development, contributing to the overall development of Phu Quoc City.
