Lao Dong newspaper has just published an article: ACV will not cancel the bidding results at Long Thanh airport.
Accordingly, the article reflects that bidding package No. 4.7 of Long Thanh airport was opened on July 29, 2024. After the bidding was opened, the contractor Deo Ca requested to cancel the results of this bidding package.
It is known that Package 4.7 (Construction and installation of equipment for aircraft parking lots, passenger terminals and other works of Component Project 3 of the Long Thanh International Airport Construction Investment Project Phase 1) is invested by Vietnam Airports Corporation (ACV).
This bid package has 2 contractor consortiums participating.
Consortium 1 consists of 8 contractors, headed by Deo Ca Group Joint Stock Company; in addition, there are Deo Ca Construction Joint Stock Company; Deo Ca Transport Infrastructure Investment Joint Stock Company; Lizen Joint Stock Company; Thang Long Corporation-JSC; Hoang Long Construction Investment Corporation-JSC; Hoa Hiep Company Limited; and Son Hai Group Company Limited (abbreviated as Deo Ca Consortium).
Consortium 2 consists of 6 contractors: The leader of this consortium is ACC Aviation Construction Corporation; Truong Son Construction Corporation; Vietnam Construction and Import-Export Joint Stock Corporation; Vietnam Construction Investment Development Joint Stock Company; Cienco4 Group Joint Stock Company; and Sau Bon Bay Aviation Construction Joint Stock Company.
On July 29, 2024, ACV opened the bid. Afterwards, ACV announced that the consortium of contractor 1 did not win the bid.
Stating the reason why this consortium did not meet the technical requirements, ACV said: The bidding documents of the consortium contractor did not meet the eligibility conditions specified in point f), section CDNT 5 of the Bidding Documents for package No. 4.7.
In which, the consortium member is Hoang Long Construction Investment Corporation - JSC (national bidding network code is vn2800177056), which has been suspended from the system from June 30, 2024 until the time of approval of the list of contractors meeting technical requirements.
Based on the review of the documents, ACV believes that the Deo Ca consortium's request that after ACV announced the results of the technical bid evaluation, including this error, and announced the results of the technical selection, there be a written opinion and additional information on the bidding network is completely inappropriate.
After the article was published, on August 25, a representative of Deo Ca Group spoke up about this issue.
The representative of Deo Ca Joint Venture said that at the time of the bidding document evaluation process, the member of the Joint Venture Hoang Long Construction Investment Corporation - JSC had a full bidding account and normal operating status on the National Bidding Network System and at this time there was no decision approving the contractor selection results for Package No. 4.7.
"The account of the Hoang Long Construction Investment Corporation Joint Stock Company is in a suspended status due to failure to pay fees on time," contractor Deo Ca explained.
Pursuant to Clause d, Point 1, Article 5 of the Law on Bidding, Deo Ca Joint Venture believes that ACV's assessment that Hoang Long Construction Investment Corporation - JSC does not meet the conditions in Clause f, Section 5 of Bidder Eligibility in the Bidding Documents is incorrect.
Deo Ca Group also emphasized: "Although the Deo Ca consortium has sent 3 petitions to ACV to request continued technical consideration, however, ACV did not accept and affirmed that the Deo Ca consortium had violated the law and was therefore forced to be eliminated from the bidding, even though the bid price of the ACC consortium was about 416 billion VND higher than the bid price of the Deo Ca consortium."
On August 15, 2024, in Document No. 1783/QLDT-CS, the Bidding Management Department responded to the eligibility of bidders. Specifically, the content of the document stated that "a bidder (an organization) that meets all the conditions prescribed in Clause 1, Article 5 of the Bidding Law is considered to meet the eligibility requirements when participating in bidding for bid packages that do not apply online bidding within the scope of this Law. The bidding documents stipulate that the bidder "is not in a state of suspension or termination of participation in the System" to ensure eligibility as for online bidding is inappropriate".
