Proposal to 'tighten' the activities of people holding positions at the State Bank when they retire

That is the proposal in the Draft Circular stipulating the list of fields and time limits for people with positions and powers who are not allowed to establish, hold titles, management positions, or operate enterprises, cooperatives, or credit institutions after ceasing to hold positions in fields under the management of the State Bank.

People holding positions at the State Bank will not be allowed to manage enterprises when they leave their positions within a certain period of time.

Accordingly, in the fields where people with positions and powers are not allowed to establish, hold titles, management positions, or operate enterprises, cooperatives, or credit institutions in the fields they were previously responsible for managing after leaving their positions.

Restricted areas include those performing state management functions for credit information organizations; granting, re-granting, changing the content and revoking licenses to provide credit information services to organizations.

The person performing the function of granting, amending, supplementing and revoking licenses to provide intermediary payment services to non-bank organizations; supervising the provision of intermediary payment services; participating in organizing and supervising the operation of payment systems in the economy ; managing payment means in the economy.

Person participating in state management of foreign exchange, foreign exchange activities and regional business activities.

The person performing the function of granting, amending, supplementing, and revoking the establishment and operation licenses of credit institutions; approving the purchase, sale, division, separation, consolidation, merger, and dissolution of credit institutions in accordance with the provisions of law; approving the proposed list of people elected or appointed as members of the Board of Directors, Board of Members, members of the Supervisory Board, and General Director (Director) of credit institutions; approving other changes in accordance with the provisions of the Law on Credit Institutions.

Person performing state management on anti-money laundering.

Person performing the function of checking, inspecting and supervising banks; checking and inspecting anti-money laundering activities.

Accordingly, the time is specifically prescribed as follows: within 12 months from the date of ceasing to hold the position according to the decision of the competent authority for the person holding the position and authority in the field of performing the state management function for credit information organizations; granting, re-granting, changing the content and revoking the license to operate and provide credit information services to organizations.

Within 18 months from the date of leaving office according to the decision of the competent authority for people holding positions and powers in the following fields:

- Person performing state management functions for credit information organizations.

- Grant, re-grant, change content and revoke licenses to provide credit information services to organizations.

- Perform the function of granting, amending, supplementing and revoking licenses to provide payment intermediary services to non-bank organizations; 4 - supervise the provision of payment intermediary services.

- Participate in organizing and supervising the operation of payment systems in the economy.

- Management of means of payment in the economy.

Within 24 months from the date of leaving office according to the decision of the competent authority for people holding positions and powers in the above fields 4, 5 and 6.
