Delegate proactive recruitment authority to the education sector
Stating the method of implementing the delegation of initiative to the education sector in recruiting and using teachers as proposed in the draft Law on Teachers, the Ministry of Education and Training said that the Ministry of Education and Training and the Ministry of Labor, Invalids and Social Affairs will be the agencies in charge of developing strategies, projects, development plans, and total staffing of teachers under their management authority to submit to competent authorities for decision.
These two agencies also preside over the promulgation of recruitment criteria and standards, pedagogical practice content in teacher recruitment exams and selection; and coordinate the number of teachers in public educational institutions according to the number assigned by competent authorities.
Draft Law on Teachers proposes many changes in recruitment and mobilization of teachers
Education management agencies take the lead (or delegate authority to educational institutions) to recruit, mobilize, arrange, evaluate, and appoint teachers. The draft law stipulates that the appointment is advised, decided, or recognized by the education management agency in accordance with the assigned authority.
Also according to the Ministry of Education and Training, the regulations on teacher recruitment in the draft law set out a number of requirements to meet the professional characteristics of teachers, which are different from civil servants in other sectors and fields (public teachers), and different from pure workers (non-public teachers).
In particular, an important adjustment in teacher recruitment is: recruitment method through selection or exam, which must include pedagogical practice. According to the Ministry of Education and Training, the requirements Recruiting teachers with pedagogical practice will help increase the professional quality of those recruited as teachers, choosing the right people for the profession.
The Government shall specify in detail the conditions, processes, procedures, priority subjects, forms, and contents of examinations and recruitment of teachers; special recruitment of teachers; and recruitment of foreign teachers.
Public teachers are special employees.
The Law on Teachers applies to teachers in public educational institutions and teachers in non-public educational institutions. "For the first time, the legal status of non-public teachers is fully and consistently established as teachers, not just as employees under the labor contract mechanism," the Ministry of Education and Training stated.
According to the draft law, teachers in public educational institutions are special civil servants. Accordingly, public teachers are still civil servants, implementing the provisions of the Law on Civil Servants (recruitment, use, management, salary scale system, etc.) and are subject to the management of competent state management agencies, and are also subject to the specific regulations for teachers in this law.
Non-public teachers and foreign teachers are special workers, subject to the provisions of the Labor Code and additional special provisions for teachers in this law.
Supplementing regulations on teacher mobilization
The draft Law on Teachers stipulates situations of using teachers associated with the characteristics of the school level and training level, including: mobilization, secondment, transfer, inter-school and inter-level teaching. "These policies, especially teacher mobilization, are expected to be a solution to solve the problem of local teacher surplus and shortage in the recent past at preschool and general education levels," according to the Ministry of Education and Training.
Also according to the draft law, in case of transferring teachers from public educational institutions to educational management agencies, seniority allowances and preferential allowances for teachers will be reserved for a maximum period of 12 months. After the reservation period, the policies and regimes of the new job position will be implemented.
