The Law on Advertising (amended) stipulates that influencers must directly use the product when posting opinions and feelings about the product.


Advertisements must be truthful and not misleading about features.

This morning (November 8), continuing the 8th session, the National Assembly listened to Minister of Culture, Sports and Tourism Nguyen Van Hung present the Proposal on the draft Law amending and supplementing a number of articles of the Law on Advertising.

Mr. Nguyen Van Hung said that the draft Law amends 4 articles, adds 2 articles and 1 clause to make regulations on advertising content and form suitable for the diverse development of advertising activities.

Specifically, amend and supplement the concept of advertising product transporter and add regulations on requirements for advertising content.

Accordingly, advertising content must be honest, accurate, clear, and not misleading about the features, quality, uses, and effects of products, goods, and services.

In case the advertisement includes notes or recommendations, the notes or recommendations must be presented clearly, completely and easily accessible. Identify the advertisement content.

The draft Law also supplements the rights and obligations of the person delivering the advertising product. In particular, it clearly requires the responsibility of the person delivering the advertising product as an influential person.

The person delivering the advertising product has the following responsibilities: Providing documents related to advertising content, revenue, product name, quantity of each product arising from periodic advertising activities as required by the tax authority or when requested by a competent state agency.

The person who delivers the advertising product is an influencer who has the following responsibilities: informing consumers in advance that he/she is advertising; when posting opinions and feelings about the results of using cosmetics, health protection foods, and dietary supplements on social networks, he/she must be a person who has directly used the product.

Need to deal with the behavior of not directly using the product but still advertising it

Presenting the Report on the review of the draft Law amending and supplementing a number of articles of the Law on Advertising, Chairman of the Committee on Culture and Education Nguyen Dac Vinh said that the Committee on Culture and Education agrees with the policy of having specific and clear regulations on the rights, obligations and responsibilities of those who transmit advertising products, including those who transmit advertising products as influential people.

Regarding specific regulations, the Committee on Culture and Education believes that the draft Law does not clearly separate the responsibilities of the person transmitting advertising products, who is an influencer, and the person transmitting advertising products in general, leading to incompatibility with some groups of people transmitting advertising products.

It is necessary to continue to review and provide specific guidance on how and in what form to notify consumers in advance that influencers are conducting advertising activities.

The draft law has not yet specified Confirmation mechanism for influencers who "have directly used the product" when posting opinions and feelings about the results of using cosmetics, health foods, and dietary supplements on social networks as well as sanctions.

Therefore, it is recommended that the drafting agency research and design this content in a direction that specifically defines the position, role, and responsibilities of organizations and individuals in online advertising activities.

On that basis, there are appropriate regulations for those who transmit advertising products, especially those who have influence on the internet. Continue to review to ensure consistency with the Law on Consumer Protection in 2023.
