Voters in Thai Binh, Ha Tinh and Ha Nam provinces proposed that the Ministry of National Defense study and submit to the National Assembly for consideration and amendment of some contents of the Law on Officers of the Vietnam People's Army to ensure the rights of officers.
According to current law, the retirement age of lieutenants and colonels in the army is 3 to 5 years lower than that of police officers. Specifically, majors and lieutenant colonels retire at the age of 48 and 50, when their social insurance contributions have not been completed for 35 years, so they do not receive their full pension.
Voters also proposed shortening the time limit for considering military rank promotions; supplementing housing policies, and providing incentives for social housing and public housing for active officers.
Responding to voters, the Ministry of National Defense said it is summarizing the implementation of the Law on Officers of the Vietnam People's Army from the regimental level and equivalent up to the ministerial level. The draft Law amending and supplementing a number of articles of the law has been prepared for the Government to submit to the National Assembly for consideration and approval at the 8th Session in October.
The draft supplements the basic positions of officers and raises the age limit for active service of officers from one to five years so that major and lieutenant colonel officers upon retirement will basically receive the maximum salary according to the provisions of the Law on Social Insurance.
The draft law also aims to overcome practical difficulties and shortcomings in housing policies and regimes for officers, ensuring feasibility and conformity with the legal system and the nature and tasks of the Army as a special labor sector.
At the meeting to collect opinions on the draft law in July, the Ministry of National Defense said that in preparation for the age limit increase, the ministry will focus on solutions such as increasing postgraduate training quotas, reviewing and training career transitions for redundant officers to optimize the personnel structure and meet new mission requirements.
In addition, agency and unit leaders proactively rotate and rotate cadres from surplus to shortage areas, from favorable areas to difficult areas, permanent framework units and local military agencies.
The draft aims to improve the quality of the staff by flexibly adjusting the age of holding positions, extending the working time for highly qualified people and at the same time eliminating cases that do not meet the requirements.
The Ministry also proposed extending the military service age for officers who are professors, associate professors, doctors, specialist doctors, specialist pharmacists, chief engineers, leading scientists or in special cases, in order to concretize the Party's policy on attracting and using talents.
The age of active service is the highest age limit for service according to the military rank of officers and professional soldiers as prescribed in the Law on Officers and the Law on Professional Soldiers, Workers and Civil Servants of National Defense. For officers, the age of active service is implemented according to the provisions of Article 13 of the Law on Officers, the rank of lieutenant is 46; major is 48; lieutenant colonel is 51; senior colonel is 54; colonel is 57 for men and 55 for women; general is 60 for men and 55 for women.
When the military has a need, officers with sufficient political and moral qualities, good professional skills, good health and volunteering can have their service age extended compared to the highest age limit according to the above military rank for no more than 5 years; in special cases, it can be extended longer.
