On March 25, full-time National Assembly deputies gave their opinions on the draft Law on Digital Technology Industry.

Giving comments on the draft law, delegate Trinh Tu Anh (Lam Dong Delegation) said that the draft classifies artificial intelligence systems, including "high-risk artificial intelligence systems".

By definition, this is an artificial intelligence system that is capable of causing serious risks and harm to human health, human rights and interests, public interests and social order and safety.

However, Ms. Anh is concerned that the draft does not clearly define the scale and criteria for high risk so that it can be applied and managed in practice. Therefore, Ms. Anh recommends that specific principles for managing artificial intelligence systems must be included in this draft law.

Regarding digital technology human resources, in the report explaining, receiving and revising the draft law of the National Assembly's Committee on Science, Technology and Environment, it is stated that the draft law has stipulated a number of policies to develop human resources such as: developing human resources in enterprises, the state implementing programs to support retraining and advanced training through the digital technology industry development program and local budgets; attracting high-quality human resources, exempting personal income tax for 5 years, 5-year visa, exempting work permits; civil servants and public employees working in digital technology who have transferred to work at digital technology enterprises and wish to be given priority to be re-admitted as civil servants and public employees; being considered as a special case when appointing leadership and management positions; attracting and using talented people to enjoy the mechanism for high-quality human resources and enjoying special mechanisms on salary, bonus, recruitment, use, and appointment in agencies, organizations, and enterprises; Support for working environment, living environment, housing, transportation for talents and their families.

Delegate Tran Van Khai (Ha Nam delegation) stated that Resolution 57 of the Central Committee requires an open management mindset, removing the regulation that if it cannot be managed, it must be banned. However, the provisions on the scope of testing in this draft are still narrow, leaving out many subjects in innovation. The draft also has many prohibited acts, and sets many conditions in business. Such an approach will make businesses hesitant.

From there, Mr. Khai suggested expanding the sandbox testing content, simplifying procedures, and empowering the Government to allow piloting new unregulated experimental models. If this is done, the law will have a better lifespan.

In addition, Mr. Khai is also interested in the issue of developing the data economy, considering it a strategic resource in the spirit of Resolution 57. Meanwhile, the draft law does not have an effective sharing mechanism, nor does it have regulations to expand the data market. This will lead to an untapped "data gold mine".

Mr. Khai recommends, promotes, and forms data centers and exchanges while still ensuring privacy when sharing data for the development of the data industry.

In addition, Mr. Khai also proposed and drafted specific regulations to have outstanding preferential policies and regimes to attract talents and excellent students to strategic technology industries, and to exempt and reduce income tax for senior experts.

Delegate Pham Trong Nghia (Lang Son Delegation) also assessed that the draft law has provided a number of incentives to train and attract human resources for the digital technology industry through policies such as scholarship support; attracting foreign experts and promoting talents.

However, according to Mr. Nghia, attracting human resources, especially digital technology talent, requires a high level of international competition. To attract international talent and avoid the loss of domestic talent, preferential policies must be outstanding, specific, and special as determined in Resolution 57, and must be competitive enough with other countries. Therefore, it is recommended that the drafting agency report more on the preferential policies of some countries in the ASEAN region.
