At the morning meeting on May 27, Session 5, 15th National Assembly, Mr. Le Tan Toi, Chairman of the National Defense and Security Committee presented the Report on the review of the revised Law on People's Public Security.
He said that the majority of opinions in the Committee agreed to add 6 general positions as in the draft Law. This addition does not exceed the number of general positions in the People's Public Security as prescribed by the Politburo; it is consistent with the practical needs of the work and the new organizational structure of the Ministry of Public Security.
Mr. Le Tan Toi, Chairman of the National Defense and Security Committee, spoke on the morning of May 27.
The National Defense and Security Committee also agreed with the regulation that a seconded officer approved for the position of Chairman of the National Defense and Security Committee of the National Assembly has the highest rank of Senior Lieutenant General.
"This regulation ensures correlation in the political system, decentralization of command in the police, in accordance with the spirit of the Central Executive Committee on the list of titles, leadership positions and equivalents of the political system from the Central to the grassroots level," Mr. Toi emphasized.
The Committee representative also requested the drafting agency to study and propose adding a seconded general position, assigned by the Party and elected by the National Assembly to hold the position of Vice Chairman of the National Assembly.
Regarding the proposal to add a major general rank position in the Departments under the Ministry of Public Security, the majority of opinions in the National Defense and Security Committee agreed, saying that the content is consistent with the organizational practice in the police. However, it is necessary to fully and comprehensively evaluate, ensuring the correlation of the highest rank and command hierarchy, especially the two positions of Deputy Director of the Department at the units under the Ministry of Public Security.
Previously, General To Lam, Minister of Public Security, authorized by the Prime Minister, submitted to the National Assembly to add 6 positions with the highest rank of general to ensure practical requirements and organizational activities of the Ministry of Public Security.
Specifically, the rank of Senior Lieutenant General for the seconded police officer was approved for the position of Chairman of the National Defense and Security Committee of the National Assembly. The five positions with the highest rank of Major General include the Principal of the People's Police University; Principal of the People's Security University; an Assistant to the Politburo member and Minister of Public Security; and two Deputy Director positions at units under the Ministry of Public Security.
According to General To Lam, the Law on People's Public Security currently only specifically stipulates 199 positions with the highest rank of general, including one general, six senior generals, 35 lieutenant generals and 157 major generals. Other positions have not been regulated or have only been regulated on the basis of principles, so the practical implementation of the Law is facing difficulties and obstacles.

On the other hand, the organization of the police apparatus at all levels has been reformed. The Ministry no longer has general department-level units, but only department-level units and equivalent units. In which, most of the heads of department-level units and equivalent units have the highest rank of lieutenant general or major general, but there are still heads of some units equivalent to department level that have not been regulated to have the highest rank ceiling of general.
"This creates a lack of uniformity and unity in regulations on ranks for positions and titles," said the Minister of Public Security.
Regarding the position of Chairman of the National Assembly's Committee on National Defense and Security, Mr. To Lam explained that the Ministry of Public Security has a deputy minister (according to regulations, the highest rank is Senior Lieutenant General) seconded to be approved for this position. According to regulations on the National Assembly's position system, the Chairman of the National Assembly's Committee on National Defense and Security is equivalent to the position of Minister and is included in the Party Central Committee. Therefore, the addition of this provision is appropriate.
Regarding the five positions with the highest rank of Major General, the Minister of Public Security said that it is in accordance with the provisions of the Law on People's Public Security. The directors of the People's Security, People's Police, and People's Public Security Political Academies have the highest rank of Lieutenant General; the directors of the International Academy, the principals of the Fire Prevention and Fighting, and the Engineering - Logistics universities of the People's Public Security have the highest rank of Major General.
In addition, an Assistant to a Politburo member and Minister of Public Security has the highest rank of Major General because according to Regulation No. 30/2021 of the Politburo, for the position of Assistant and Secretary, a Politburo member has two Assistants. Meanwhile, the Law on the People's Public Security stipulates that an Assistant to a Politburo member and Minister of Public Security has the highest rank of Major General, so it is necessary to stipulate two Assistants to a Politburo member and Minister of Public Security with the highest rank of Major General for consistency.
This afternoon, the National Assembly will discuss in groups the draft Law amending and supplementing a number of articles of the Law on People's Public Security and discuss in the hall on June 2; vote to pass it on June 22.
