The working regime of general education teachers and pre-university teachers is currently implemented according to the regulations of the Ministry of Education and Training in Circular No. 28/2009/TT-BGDDT and Circular No. 15/2017/TT-BGDDT. However, after many years of implementation, facing changes in the content and methods of education and training in the new context, some regulations in Circular No. 28/2009/TT-BGDDT and Circular No. 15/2017/TT-BGDDT are no longer suitable. Therefore, the Ministry of Education and Training has developed a Circular regulating the working regime for general education teachers and pre-university teachers to replace the above Circulars.
The Draft Circular has a number of new provisions and adjustments compared to current Circulars, as follows:
Teachers' working hours are implemented according to the school year, converted into teaching hours in 01 school year or average teaching hours in 01 week so that the school can be flexible in assigning and arranging teachers to implement the 2018 General Education Program and conveniently calculate overtime pay. In case teachers have to be assigned to teach more than the average teaching hours in 01 week (including converted teaching hours for concurrent tasks), the number of teaching hours in excess must not be greater than 25% of the average teaching hours in 01 week to ensure teachers' work efficiency and ensure regulations on overtime in the Labor Code.
The unified regulation on the number of actual teaching weeks for teaching educational content in the general education program is 35 weeks to ensure compliance with the regulations in the 2018 General Education Program and the guidance of the Ministry of Education and Training on the school year time frame.
Regulations stipulate that teachers teaching in general schools with many levels of education are appointed to the professional title of teacher at which level of education, then implement the prescribed teaching period norms for teachers at that level of education and 01 assigned teaching period is calculated as 01 standard period to implement the unified teaching period norms for teachers in general schools with many levels of education and in line with the current trend of rearranging general schools.
It is stipulated that each teacher cannot hold more than 02 concurrent tasks (including concurrent professional work; concurrent positions in the Party, mass organizations and other organizations; concurrently holding other job positions) to ensure that teachers focus on teaching and education tasks.
Regulations stipulate that concurrent tasks that have received remuneration or allowances must not have their teaching hours reduced and cannot be converted into teaching hours (except for concurrent tasks of trade union work, youth union secretary, and deputy youth union secretary at the school level) to avoid duplicate payment of regimes and policies for the same task.
The draft also adds cases that do not have to make up lessons and are considered to have taught the full number of assigned periods, including cases where teachers are absent for medical examination and treatment (not exceeding the prescribed time) with the consent of the school principal and have confirmation of medical examination and treatment from a medical facility.
Regulate the number of teaching periods for teachers working as General Managers of the Ho Chi Minh Young Pioneers Team into 02 levels according to class size (equivalent to the current teaching period norms of grade 1 and grade 2 schools) and specify the standard number of periods instead of regulating the ratio of standard number of periods/week of the corresponding grade level and according to each school class as currently.
Increase the number of reduced periods for homeroom teachers at primary level to 4 periods/week like homeroom teachers at secondary and high school levels to ensure consistency with the duties of homeroom teachers and consistency between levels.
