The Department of Planning and Investment of Quang Tri has just issued a document proposing to the Provincial People's Committee a solution to the Food Court and Night Market project in Ward 2, Dong Ha City. Accordingly, the Department of Planning and Investment proposed that the Chairman of the Provincial People's Committee assign the Dong Ha City People's Committee to review the investor's violations, and if qualified, terminate the project contract according to the provisions of the contract signed between the Dong Ha City People's Committee and Trieu Phat Trading Company Limited (Quang Ngai).

Regarding the reason, during the implementation of the Food Court and Night Market project in Ward 2, Trieu Phat Trading Company Limited committed many violations. Specifically, this company had its business registration certificate and legal seal revoked by the Business Registration Office, Department of Planning and Investment of Quang Ngai province since December 2019.
Thus, after 5 months from the time of signing the contract with the People's Committee of Dong Ha City, Trieu Phat Trading Company Limited no longer has legal status. However, the company representative did not inform the People's Committee of the city but continued to use the legal entity and company seal in activities at the night market in Ward 2, Dong Ha City (signing contracts with small traders and businesses in the area), which is contrary to current regulations.
During the project implementation, in April 2021, Trieu Phat Trading Company Limited was administratively sanctioned by the People's Committee of Dong Ha City with a fine of 50 million VND for organizing the construction of the project contrary to the content of the granted construction permit. However, the company only paid the fine, but the current status of the kiosks is still inconsistent with the content of the granted permit; used for rent is not in accordance with the signed contract as a product display house.
In addition, through on-site inspection and initial verification by the authorities, it was found that Trieu Phat Trading Company Limited signed premises lease contracts with a number of organizations and individuals that were not in accordance with the approved project content.
For example, at the location adjacent to Ward 2 night market and Phan Huy Chu street, the company rented the location to an individual to build a coffee shop; at the location adjacent to Ward 2 night market, Phan Huy Chu street and Bach Thai Buoi street, the company rented the location to another individual, organized the construction of a grocery and clothing store; at the location adjacent to the back of house number 139 Le Duan, the company rented the location to build a car parking garage; at the location adjacent to the warehouse of the night market, another individual rented the location, built a structure to store furniture...
According to the contract signed between the company and the People's Committee of Dong Ha City in July 2019, starting from 2020, the company must pay the rent to the state budget of 160 million VND/year, the deadline for payment is before December 20 every year, but the company has not yet complied with the signed contract.
During the night market shutdown, the investor lacked management, causing some households to collect garbage in an unsanitary manner, and the space was used as a parking lot, causing negative public opinion. The company did not cooperate with the process of coordinating the provision of relevant documents about the project, causing difficulties in consulting and handling related issues.
It is known that recently, Dong Ha City People's Committee has sent many documents to the company regarding the early implementation of the Food Court and Night Market project in Ward 2; the Finance - Planning Department has also contacted and worked directly with Trieu Phat Trading Company Limited many times to urge them; the company has also made a commitment but so far has been slow to implement it according to the request of the City People's Committee.
Regarding the Food Court and Night Market project in Ward 2, Dong Ha City, Quang Tri Newspaper previously published articles reflecting on Trieu Phat Trading Company Limited's violation of the contract signed with Dong Ha City People's Committee, the company did not correct the violations as committed, and the newspaper also recommended the competent authority to handle the matter in the direction of terminating the contract with this enterprise.
