National Assembly deputies propose a mechanism for rapid investment in infrastructure serving science and technology

Kinhtedothi- According to National Assembly delegates, to promote rapid development of science, technology, innovation and national digital transformation, the most important thing is to have mechanisms to quickly invest in infrastructure serving science, technology, innovation and digital transformation.


On the morning of February 17, at the 9th Extraordinary Session, the 15th National Assembly discussed in the hall the draft Resolution on piloting a number of policies to remove obstacles in science, technology and innovation activities.

Applying turnkey contracting for scientific and technological activities

Speaking at the discussion, National Assembly delegate Nguyen Thi Kim Thuy (National Assembly Delegation of Da Nang City) said that from local practice, it shows that in order to promote rapid development of science, technology, innovation and national digital transformation in the current situation, especially attracting high-quality human resources to work, taking the lead in new technologies and future technologies, the most important thing now is to have mechanisms to quickly invest in infrastructure serving science and technology, innovation and digital transformation, such as: Working space; modern showrooms and exhibitions; laboratories (Lab); Laboratory combined with experimental production (Lab-Fab) ... meeting international standards to serve design and training work towards building testing and packaging factories in the fields of semiconductors and AI; biotechnology research laboratories; New technology testing site with infrastructure for energy, clean water, digital infrastructure, data centers, fiber optic cables, 5G, 6G transmission stations...

However, at present, Vietnamese legal regulations do not exist or are only general, especially the procedures for investment and construction are cumbersome, there are no specific technical standards and do not meet the requirements of Resolution 57-NQ/TW. Therefore, the delegates proposed that the National Assembly consider adding one or several articles.

Specifically, on the special procedures and order in investing in science and technology infrastructure using the State budget and the investment mechanism combining the State budget with non-State capital and other legal capital sources (investment in cash, asset value, machinery and equipment; management and operation costs, maintenance; funding by science and technology products purchased from abroad, purchased from domestic and foreign enterprises; financial support for Labs, Lab-Fabs, large-scale production plants according to State requirements...).

Including regulations: handing over cleared land (clean land) in the form of direct land handover without auction, bidding for projects using land and not collecting land use fees for 10 years or more, then exempting 50% of land use fees for the following period (if the project is effective).

Along with that, there are forms of turnkey bidding, designated bidding or shortened bidding... as stipulated in the draft Resolution on investment in the Ninh Thuan nuclear power project; procedures for approving investment policies and approving investors are applied as stipulated in Clause 8, Article 2 of the Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership method and the Law on Bidding (Article 36a of the Law on Investment) which has just taken effect from January 15, 2025.

Regarding the procedures for managing, exploiting and using invested infrastructure, National Assembly delegate Nguyen Thi Kim Thuy proposed that assets fully invested by the State be leased to collectives and individuals engaged in scientific and technological research and development, innovation and digital transformation without auctioning the right to exploit and use; exempting or reducing rental fees or allowing shared use for research and training purposes...

With assets combining State capital and non-budgetary capital, State agencies exercise management rights, assign startups, enterprises, scientists, groups of experts, etc. the right to exploit and use and bear operating costs (the State can partially support management and operating costs).

In addition, there is a breakthrough mechanism on intellectual property rights for products from scientific research, technology and innovation on infrastructure with State capital or capital combining State and private capital in the direction: "Researchers enjoy full intellectual property rights for these products or there is an agreement between the product maker and the State management agency".

In addition, the provisions of Article 4 of the draft Resolution on the mechanism for commercialization of scientific, technological and innovative products from state-invested infrastructure shall apply.

Supplementing a mechanism to shorten procedures for commercializing science and technology products

Participating in the discussion, National Assembly delegate Tran Thi Nhi Ha (National Assembly Delegation of Hanoi) said that currently, many enterprises, universities and research institutes are ready to innovate and take action in scientific and technological research activities. Therefore, the delegate proposed that ministries, branches and localities must allocate at least 20% of the public procurement budget to order domestic scientific and technological products. At the same time, ministries, branches and localities must annually issue a "list of scientific and technological product orders" so that organizations, state units, private enterprises and even individuals can register to participate and receive output support after successful research.

In addition, National Assembly delegate Tran Thi Nhi Ha also proposed adding a mechanism to shorten the procedures for commercializing scientific and technological products. For example, an artificial intelligence (AI) software product supporting healthcare may be required to be registered with both the Ministry of Health and the Ministry of Information and Communications. Therefore, there should be a common process for products to avoid overlap between ministries and sectors.

According to National Assembly delegate Hoang Van Cuong (National Assembly Delegation of Hanoi), not all research results can be applied through businesses because many new research results can become applications in businesses.

“It is necessary to add Article 9 in the Draft on the right to commercialize research products. Research products may not be applicable in enterprises but can be sold to others. Agencies and units can buy them to continue research and application later” - National Assembly delegate Hoang Van Cuong proposed a solution.

Agreeing on policies to implement digital transformation, however, National Assembly delegate Pham Van Hoa (National Assembly delegation of Dong Thap province) requested to clarify the average investment expenditure of 15% for equipment of a 5G BTS station, because the 15% support expenditure is very difficult, businesses can list it to receive support. Support for land, premises, taxes as well as bank loan interest rates = 0.

Along with that, the delegate proposed to clarify the infrastructure support for businesses to develop 5G when telecommunications businesses are currently doing well, with very high profits compared to many other businesses. At the same time, clarify the concept of strategic digital technology and digital technology with special characteristics. Regarding autonomy and self-responsibility, the delegate proposed to clarify what the highest level is. In addition, allowing participation in contributing capital shares, operating businesses... but in cases where they only work for hire, where do they receive their salary, at the business or at the governing body, because receiving salary in two places is unreasonable.

“In addition, regarding risk acceptance, it is necessary to clarify whether the implementation involves risks according to the legal procedures or the procedures according to the signed contract. In cases where risks occur repeatedly, the competent authority needs to review them. It is impossible to let risks continue to occur,” said delegate Pham Van Hoa.
