On July 2, the Department of Education and Training of Ho Chi Minh City announced that it had decided to suspend the operations of the American International Primary, Secondary and High School (Nha Be District, Ho Chi Minh City).
Accordingly, the Department of Education and Training of Ho Chi Minh City and the Interdisciplinary Working Group had a working session with the investor and the board of the American International School (AISVN) on May 28, 2024.
At the meeting, the Department of Education and Training of Ho Chi Minh City requested the investor and the school board to submit a report before June 15, 2024 to the Department of Education and Training (the report must include evidence demonstrating that the conditions for educational activities are met according to the provisions of the 2019 Education Law and a general report on the payment of debts to tax authorities, social insurance, salaries for teachers, staff, and other educational services).
However, after June 15, 2024, the Department of Education and Training of Ho Chi Minh City has not received a report from the unit to determine that the American International Primary, Secondary and High School is qualified to operate education according to the 2019 Education Law and Decree 46/2017/ND-CP.
Therefore, based on the provisions of Point b, Clause 1, Article 50 of the 2019 Law on Education and Point b, Clause 1, Article 30 of Decree No. 46/2017/ND-CP of the Government, due to not ensuring the conditions for being permitted to conduct educational activities, specifically not having enough financial resources as prescribed to ensure the maintenance and development of educational activities; the number of educational managers is not sufficient to implement the educational program and organize educational activities; the Department of Education and Training of Ho Chi Minh City has issued Decision No. 2042/QD-SGDĐT (dated June 28, 2024) on suspending the school's educational activities.
The suspension period is 12 months from 1-7-2024.
In order to ensure the legitimate rights and interests of students, the Department of Education and Training of Ho Chi Minh City urgently implements solutions to handle and resolve issues after suspending the operations of the American International Primary, Secondary and High School.
Accordingly, the Department of Education and Training has worked with 18 high schools with investment capital and teaching foreign programs to collect statistics on reception capacity and support policies for students who want to transfer from the American International School.
For schools teaching the International Baccalaureate (IB) program alone, the city's capacity to accept students in the 2024-2025 school year is 1,251 places, more than the number of students currently studying at the American International Primary, Secondary and High School.
Up to now, according to reports from educational institutions, there have been 134 cases of parents of American International Primary, Secondary and High School transferring schools for students.
According to the guidance of the Ho Chi Minh City Department of Education and Training, students in grades 1, 2, 3, 4, 5, 6, 7, and 8 in the 2023-2024 school year can transfer to public and non-public high schools teaching the general education program of the Ministry of Education and Training; schools implementing the integrated program; and foreign-invested schools teaching the International Baccalaureate (IB) program.
Students in grades 9, 10, and 11 in the 2023-2024 school year can register to transfer to non-public high schools teaching integrated programs; foreign-invested schools teaching foreign programs and the International Baccalaureate (IB) program.
In addition, the Department of Education and Training of Ho Chi Minh City requires responsibility for American International Education Joint Stock Company and American International Primary, Secondary and High School towards students, teachers, educational managers and staff of the school on the basis of obligations and responsibilities towards the rights and legitimate interests of students, teachers, educational managers and staff.
Specifically, for students, it is necessary to implement appropriate solutions, ensure students' learning rights, not let students' learning be interrupted; have solutions to stabilize the psychology of students and their parents.
For teachers, managers and employees, it is necessary to ensure the implementation of policies and regimes (salary, allowances, social insurance, health insurance, unemployment insurance) according to the agreement with the employee in the signed labor contract; fully implement the regulations on the use of foreign workers in accordance with the law.
