What can traffic police do when a driver runs away and threatens law enforcement officers?

(Dan Tri) - According to the new Circular, public servants are allowed to use force, support tools or weapons when violators act in opposition.

The Ministry of Public Security has just issued Circular No. 69/2024/TT-BCA regulating the command and control of road traffic by the Traffic Police.

The Circular takes effect from January 1, 2025, replacing Circular No. 26/2017/TT-BCA dated August 22, 2017 of the Minister of Public Security regulating the command and control of road traffic by the Traffic Police.

In Article 19, the new Circular stipulates "resolving cases where violators do not comply with the handling of violations of road traffic order and safety by the Traffic Command and Control Police; motor vehicles stop and park causing traffic congestion".

Accordingly, in case the violator does not comply with the handling of violations of road traffic order and safety, the traffic police will briefly and clearly explain to the violator his/her violation and the solution according to the provisions of law so that he/she voluntarily complies.

If the violator does not comply, the traffic police will temporarily detain the documents or vehicle, invite witnesses to sign the temporary detention record, then invite the violator to the unit's headquarters for settlement or instructions on how to file a complaint according to the provisions of law.

In case a motor vehicle stops or parks causing traffic congestion, the circular stipulates that the traffic police will require the driver to present relevant documents for inspection, remove the vehicle from the traffic congestion area, draw up an administrative violation report if the driver stops or parks in violation of regulations or does not comply with the command and control orders of the traffic police and handle the case according to regulations; at the same time, organize forces to guide, control traffic, and clear traffic congestion.

In case the driver closes the door and leaves or is not present, the traffic police use professional technical equipment to record images, report to the unit commander to take measures to remove the vehicle from the traffic jam area, invite witnesses, seal the necessary locations of the vehicle and make a record according to regulations; at the same time, organize forces to guide, control traffic, and clear traffic jams.

In particular, in situations such as: The driver flees; the violator incites and entices others to obstruct the person performing official duties; the violator insults, threatens, obstructs, or pushes the person performing official duties; the violator requests to see the patrol and control plan; records and records the activities of the traffic police while on duty; takes advantage of social networks to provide and share fake, untrue, distorted, and slanderous information about the traffic police force; the driver drives the vehicle into the person performing official duties... The Circular stipulates that the Traffic Police must comply with the provisions of Article 73 of the Law on Road Traffic Order and Safety and the regulations of the Ministry of Public Security on professional work.

According to Article 73 of the Law on Road Traffic Order and Safety, officers on duty are allowed to use force, support tools or weapons as prescribed by law to prevent violations and for legitimate defense; and are allowed to exercise the right to pursue to prevent and handle violations.
