ANTD.VN - The People's Committee of Bac Giang province has just issued a decision to fine Capella Real Estate Joint Stock Company VND 135 million for constructing a project without a construction permit.
Capella Real Estate Joint Stock Company is the investor of the project to invest in the construction and business of infrastructure of Yen Lu Industrial Park, Yen Dung District, Bac Giang Province. Address: 6th floor, Samsora Premier Building, No. 105, Chu Van An Street, Yet Kieu Ward, Ha Dong District, Hanoi City, with Mr. Bui Dinh Chien as General Director.
Specifically, this Company committed a violation by organizing construction work without a Construction Permit, which is required by regulations.
At the time of inspection, the Investor was organizing the construction of the Wastewater Treatment Plant under the Investment, Construction and Business Project of Yen Lu Industrial Park Infrastructure, Yen Dung District, Bac Giang Province, within the land boundary assigned by the Provincial People's Committee in Phase 4 and Phase 5.

The violation is specified in Clause 2, Article 3 of Decree No. 16/2022/ND-CP dated January 28, 2022 of the Government; Point b, Clause 1, Article 9 of Decree No. 118/2021/ND-CP dated December 23, 2021 of the Government detailing a number of articles and measures to implement the law on handling administrative violations. The Company was fined VND 135 million by the Provincial People's Committee.
At the same time, Capella Real Estate Joint Stock Company must take remedial measures to stop construction. Within 90 days from the date of issuance of the decision on administrative sanctions, the Company must complete the application for a construction permit from the competent authority and obtain a construction permit. If the time limit for implementing remedial measures as prescribed expires and Capella Real Estate Joint Stock Company fails to present a construction permit, it will be forced to demolish the construction or the part of the construction that violates the regulations. In case of non-compliance, it will be forced to comply according to regulations.
In addition, Capella Real Estate JSC must pay the fine within 10 days from the date of receipt of this Decision. The Decision also assigns Mr. Bui Dinh Chien, the representative of the organization violating this Decision, to comply. If after the deadline Capella Real Estate JSC does not voluntarily comply, it will be forced to comply according to the provisions of law.
Previously, on April 7, 2023, Capella Real Estate Joint Stock Company was fined 130 million VND by the Chairman of the People's Committee of Bac Giang province for constructing a project without a construction permit for the Yen Lu Industrial Park Infrastructure Investment, Construction and Business project, with items, part of traffic routes D5, D6, N1 and the returned cemetery, on the land area assigned in the first and second phases.
