Discussing the above content, Mr. Nguyen Duc Manh, Chairman of Minh Duc Commune People's Committee, said that although the Thanh Duc ecological service project of Bui Duy Van's business household was discovered by the authorities to be in violation and reported to Tu Ky District People's Committee, up to now, Mr. Van's household has not stopped to wait for the completion of legal procedures but continues to violate.
Previously, in January 2024, Mr. Bui Duy Van's business household was administratively fined 40 million VND by the Chairman of Tu Ky District People's Committee for violating the provisions of the license for activities within the protection area of the irrigation works. At the same time, the right to use the license was revoked for a period of 2 months, forcing the restoration of the original state of the land before the violation.
According to the penalty decision, Bui Duy Van business household was granted license No. 418 by the Department of Irrigation (Ministry of Agriculture and Rural Development) to carry out construction activities of Thanh Duc ecological service cluster within the protection area of Dinh Dao canal irrigation works.
However, Mr. Bui Duy Van's household arbitrarily built 2 new structures that were not included in the permit. Specifically, structure 1 has a construction area of 320 m2, structure 2 has an area of 2,520 m2, both are structured with steel columns placed on reinforced concrete foundations, cement concrete floors, and corrugated iron roofs.
Mr. Nguyen Anh Tuan, Head of the Agriculture Department of Tu Ky district, said that immediately after the People's Committee of Minh Duc commune reported on the violations of Mr. Bui Duy Van's household, on June 14, 2024, the district established an inspection team consisting of relevant departments to handle the violations. The minutes clearly stated that the Bui Duy Van business household was requested to stop all construction activities of the Thanh Duc ecological service cluster and voluntarily dismantle the constructions that arose after January 19, 2024. The completion date is before June 17, 2024.
The minutes also confirmed that Mr. Van's household arbitrarily built new construction clusters that were not in accordance with the permit, which is a violation in the fields of natural disaster prevention and control; irrigation; dykes; Construction Law; and Fire Prevention and Fighting Law.
The authorities require that the items in the Thanh Duc ecological service cluster, in addition to self-clearing, return the site to its original condition; for the items in the Thanh Duc ecological service cluster in the licensing, the business household stops all construction activities to adjust and supplement the construction permit according to the provisions of law; because the license has expired, the business household is required to stop all construction activities in the Thanh Duc ecological service cluster.
Bui Duy Van Business Household must immediately stop construction activities in the Thanh Duc Ecological Service Project; no further violations are allowed. Voluntarily organize the immediate dismantling of the violating construction according to the minutes of the interdisciplinary inspection team on June 14, 2024. Urgently complete the legal procedures for construction as prescribed, and construction may only be continued when all legal procedures are complete.
Regarding the above content, Ms. Bui Thi Diu (daughter of Mr. Bui Duy Van) admitted that the construction work in the past was in violation and the family has now partially dismantled it. However, there is still a part of the violating construction that has not been dismantled because Ms. Diu said that the license is being adjusted. When asked why hundreds of square meters of the dike were transformed, filled with concrete to create a path, and even planted with a series of eye-catching ornamental plants, Ms. Diu said that the concrete was poured like that to make it look nice, so that people can walk comfortably (?!)
A leader of Hai Duong province said that regarding the above-mentioned illegal construction, the province has directed the People's Committee of Tu Ky district to closely monitor and responsibly review the violations to report to the Provincial People's Committee. If new violations arise, the leaders of the District People's Committee must be responsible to the province, not cover up the violations, and must take strict action.
