Pass the buck to the host agency

Presenting a report on the implementation of a number of resolutions of the National Assembly, Chief Justice of the Supreme People's Procuracy Le Minh Tri said that he has focused on directing professional measures to ensure better implementation of the functions and tasks of the prosecution sector according to the provisions of the Constitution and laws, especially the task of fighting injustice, mistakes, and preventing criminals from escaping.

Besides the achieved results, Mr. Tri also pointed out some difficulties and challenges that need to be solved in the coming time.

Typically, many new regulations of the judicial laws have come into effect, but the awareness among the prosecuting agencies is still inconsistent; the very strict responsibility procedures in the Law on State Compensation Liability are a big challenge for the prosecuting agencies, especially the responsibility of the Procuracy.

According to the chief prosecutor, implementing the Criminal Procedure Code has greatly increased the tasks of the prosecutor's office, from the time of receiving and handling denunciations and reports of crimes. The implementation of the regulation that prosecutors must participate in a number of investigative activities and directly investigate is facing many difficulties, especially for units with large areas and not yet having the conditions to arrange enough civil servants and prosecutors.

The number of civil servants with judicial titles and prosecutors at all levels of the procuracy has not met the requirements of increased workload; allocated funding is not sufficient to carry out the tasks of the sector.

In particular, the Chief Justice of the Supreme People's Procuracy frankly acknowledged that the appraisal and valuation work was still taking a long time, there was a phenomenon of shifting responsibility to the presiding agency; slow request for relevant agencies to provide missing documents and information. In some cases, there were even signs of fear of responsibility, avoidance, and refusal of appraisal and valuation; appraisal conclusions were still general and did not clearly express viewpoints.

Differentiate crimes, reduce punishment for those who follow orders

According to the Chief Justice of the Supreme People's Procuracy, in the coming time, the prosecution sector will perform well its tasks of combating injustice, mistakes and missed crimes; focus on strengthening the responsibility of prosecution in investigation activities according to the Criminal Procedure Code; strive to prevent cases of suspension of defendants due to non-committal convictions, and courts declaring defendants not guilty.

Along with that, we focus on solving well the cases monitored and directed by the Central Steering Committee on Anti-Corruption; promptly and strictly handle serious and complicated criminal cases that are of public concern.

The Procuracy sector will also continue to improve and streamline the organization of the Procuracy at all levels; improve the leadership of the Supreme People's Procuracy; use existing human resources reasonably and effectively; rotate, mobilize, and second prosecutors between Procuracies at all levels for training and practice to meet the requirements of assigned tasks.

Notably, the Chief Justice of the Supreme People's Procuracy recommended that the National Assembly continue to direct research and development of policies to handle crimes in the fields of economics, corruption, and positions, ensuring the requirements of both strict punishment and leniency.

The principle suggested by the director is to strictly handle the masterminds and those with profit motives to deter and educate the general public; at the same time, differentiate and create conditions for the wrongdoers to overcome the consequences, and reduce the punishment for violators because they obey orders and do not profit; in order to better recover corrupt and lost state assets.

The head of the Supreme People's Procuracy also hopes that the National Assembly will consider increasing the number of prosecutors in the assigned payroll of the prosecution sector to better perform its functions and tasks, especially newly assigned tasks; have a salary and allowance policy mechanism suitable to the specific nature of the sector's labor; increase investment in facilities, equipment and information technology infrastructure...
