'Mini apartments should only be used for rental business'

HoREA believes that the 2014 Housing Law stipulates that households and individuals in urban areas must build and renovate houses according to construction laws and take responsibility for the quality of their houses.

In case of being permitted to build a house with two or more floors, each floor is designed and built with two or more apartments in a closed style, meeting the minimum floor area standards for each apartment according to construction standards and regulations, and having a part of the area under private ownership, a part of the area under common ownership of the apartment building according to the provisions of this law, the State will recognize the ownership of each apartment in that house (granting a pink book).

According to HoREA, this regulation has given rise to many “disguised mini apartment buildings” in urban areas with 100% mini apartments and rooms. This is one of many reasons for overloading the area’s infrastructure, disrupting urban planning, causing loss of aesthetics and not ensuring fire safety as well as lacking utilities and services for residents.

Therefore, HoREA proposes not to issue pink books for mini apartments but only to let this type of apartment be rented out, the management and operation work is undertaken and the investor is responsible.

According to HoREA, the regulations on building "individual houses" are not strict, so they have been exploited, leading to the proliferation of mini apartments in inner-city areas of urban areas.

Therefore, HoREA recommends: In case of individual houses not for business purposes, there is no need to establish a project, but in case of houses for business purposes (for sale, rent, etc.), it is mandatory to establish a construction investment project and have it approved by a competent state agency.

Emphasizing this issue, Mr. Nguyen Van Dinh, Vice President of the Vietnam Real Estate Association, also said that mini apartments are a defective product of a development stage. Right from the beginning when this type appeared, the Vietnam Real Estate Association spoke out against it.

'' Mini apartments are mostly built on interspersed land, located in alleys of densely populated areas. Therefore, mini apartments have shortcomings such as putting pressure on social infrastructure, increasing population density, not ensuring fire safety standards, lacking necessary amenities for residents... Continuing to let this type of development will cause many urban and planning problems, '' said Mr. Nguyen Van Dinh.
