Chairman of the Provincial People's Committee Nguyen Duc Trung received citizen Cao Thi Thuy Tai, residing at Vinh Tea Enterprise collective housing area, hamlet 13, Nghi Kim commune, Vinh city. Ms. Tai requested the competent authority to reconsider the land allocation price and support when buying the liquidated house of Vinh Tea Enterprise due to lost invoices.
Ms. Tai stated that in 1995, she and many other households were sold collective housing in Hamlet 13B, Nghi Kim Commune (Vinh City) by Vinh Tea Enterprise at a discounted price. Since then, the families have been living stably. However, when Vinh City implemented the project to build technical infrastructure for the planning area to divide residential land in the collective housing area and the pond area of Vinh Tea Enterprise, her family did not receive compensation or support for land.
Chairman of Vinh City People's Committee Tran Ngoc Tu said that the project was implemented in 2018, with an area of over 6,800m2 . Of the 29 affected households, 21 households had to relocate, but only 13 households had documents and certificates on the price and receipts of Vinh Tea Enterprise, the remaining 8 households did not have documents on the price and receipts of Vinh Tea Enterprise, including Ms. Tai's family.
The Vinh City Land Fund Center has established a compensation and resettlement plan for 21 households. In May 2022, the Vinh City Valuation Council determined the land price at the departure location to be from 6-7.7 million VND/ m2 , and at the destination location to be from 8-9.35 million VND/ m2. The price difference between departure and arrival is 1,650 million VND/ m2 .
Regarding this land, in 2005, Vinh Tea Enterprise submitted a request to return the land. In January 2006, Nghi Loc district sent an official dispatch requesting land recovery and permission to legalize the above area to the Provincial People's Committee and the Department of Natural Resources and Environment.
Chairman of Vinh City People's Committee Tran Ngoc Tu affirmed that because Ms. Tai's family and 7 other households do not have records, documents, invoices, or receipts proving that they are the subjects of Vinh Tea Enterprise's sale and liquidation of assets on the land, these households are not in the case of land allocation beyond their authority and are not eligible for compensation consideration. Therefore, when making plans for land recovery and allocation, households and individuals will not be compensated for land according to the provisions of the 2013 Land Law.
Vinh City's viewpoint is to keep the land price unchanged. The reason is that Vinh City has determined the price in accordance with regulations; the land price is guaranteed to follow the market price at the time of price determination; the price difference between the departure and arrival locations is 1.65 million VND/ m2 due to changes in infrastructure; The land price has priority and is reasonable with the conditions of the households.
Director of the Department of Natural Resources and Environment Hoang Quoc Viet assessed that this was a complicated case, 8 households did not have invoices or documents proving that they sold their assets on the land, so they were not eligible for compensation for residential land when the State reclaimed the land and allocated resettlement land. The Department's leaders assessed that the Vinh City People's Committee had supported and created conditions for the people to the fullest extent in accordance with regulations.
After listening to the citizens’ presentations, opinions of Vinh City and the Department of Natural Resources and Environment, Chairman of the Provincial People’s Committee Nguyen Duc Trung sympathized with the situation of Ms. Tai and other households. The families have worked for a long time at Vinh Tea Enterprise, and are currently facing many difficulties in life.
To ensure the legitimate and legal rights of citizens according to regulations, the Chairman of the Provincial People's Committee assigned Vinh City to establish an inspection team, coordinate with Nghi Kim commune and enterprises to review the entire process of purchasing and pricing assets at Vinh Tea Enterprise of households.
In case it is proven that households have paid money to buy liquidated houses, compensation and support will be provided to households in accordance with regulations (if eligible). Vinh City will report the results to the Provincial People's Reception Council before October 31, 2023 and notify citizens.
Regarding the proposal to apply land prices of citizens, the Chairman of the Provincial People's Committee assessed that the process of determining land prices has been carried out by Vinh City carefully, in accordance with regulations, taking into account factors that are reasonable to the conditions of citizens. In the case of households eligible for compensation and support for land, Vinh City will review and reconsider the factors determining land prices to ensure maximum benefits for citizens.
