Create a legal corridor for security forces
Discussing in groups, President To Lam said that security work was formed right after the Party was founded to protect key officials before it gained power. Most clearly, when Uncle Ho returned to the country in 1941, the forces carried out security work to protect him as well as key leaders and core members of the Party.
Up to now, the forces have grown a lot, always ensuring the safety of leaders during the working process. The provisions in the law aim to create a legal corridor for functional forces to deploy, agencies to coordinate implementation and disseminate to the people. The security work is determined, no one protects better than the people. They are the ones who protect, protect the best and most durable.
The President stated that the security force must ensure many requirements, first of all the security and safety of the leaders. In addition, security work also has the meaning of protocol, protocol, and national prestige in terms of foreign affairs and international cooperation, especially when the Party and State leaders work abroad or vice versa.

“Over the past time, the guard force has performed very well, with almost no incidents, overcoming many difficulties and challenges and growing up a lot. In particular, leaders of countries have highly appreciated, expressed their affection and admiration for our guard force. The amendment and supplementation of a number of articles of the law aims to improve and meet practical requirements,” said the President.
The President requested the Drafting Agency to continue to complete and ensure all conditions are met, and report to the National Assembly for early approval.
Regarding the draft Law on Management and Use of Weapons, Explosives and Support Tools (amended), the President said that unlike other countries, we have a safe society, without guns, weapons or tools that threaten the safety and security of any citizen. “This is a great progress of society. Foreign visitors to Vietnam all feel very safe,” the President emphasized.
However, in reality, there are still places where gangs threaten each other using knives or unregulated tools. According to reports, stabbings are mainly caused by knives but have not been institutionalized by law, making them very difficult to handle.
“There are opinions that knives are used to serve people's daily lives, this is correct and normal, but avoid taking advantage of and using knives for the wrong purposes. There are cases where dozens of people have knives and machetes in their car trunks - it cannot be said that they are used for production. These are acts that must be strictly prohibited, even keeping them is not allowed. This issue has boundaries but there needs to be a way to manage it to build a safe society, so that all people are not threatened,” the President affirmed.
Clearly define "necessary cases" for applying security measures
Discussing in the group, delegate Nguyen Dai Thang (Hung Yen) said that the amendment and supplementation of a number of articles of the Law on Guards aims to promptly and fully institutionalize the Party's policies and viewpoints on the organization and operation of the people's police force in general and the guard force in particular, especially Resolution No. 12-NQ/TW of the Politburo on "promoting the building of a truly clean, strong, disciplined, elite, and modern people's police force to meet the requirements and tasks in the new situation".
Considering that the draft law has many contents related to the Law on People's Public Security; Law on Mobile Police; Law on Management and Use of Public Assets..., delegate Nguyen Dai Thang suggested that the drafting agency and the reviewing agency continue to review the provisions in the draft, especially the amended content, to ensure consistency and consistency with related laws.
Sharing the same view, delegate Tran Thi Hong Thanh (Ninh Binh) stated: “To amend this law, it is necessary to review 31 related legal documents. I request the Drafting Committee to continue reviewing to ensure consistency in the system of legal documents when amending and supplementing the draft law.”
Delegate Tran Thi Hong Thanh said that, according to the draft law, the addition of authority for the Minister of Public Security to decide to apply security measures in necessary cases for subjects not falling under the prescribed cases, is "still general"; it is necessary to study to determine specifically which cases are necessary, strictly regulate in the law, clearly define in the law to ensure constitutional requirements.
High-damage knives should be classified as primitive weapons.
Giving comments at the group on the draft Law on Management and Use of Weapons, Explosives and Supporting Tools (amended), delegate Le Nhat Thanh (Hanoi) proposed to classify knives with high lethality as primitive weapons, when used for the purpose of infringing upon human life and health; thereby having a basis for handling criminals using this type of knife to commit crimes.
The delegate said that according to the report of the Ministry of Public Security, in the past 5 years, the whole country has discovered and arrested over 16,000 cases with about 26,000 subjects using knives and tools and means similar to knives to commit crimes. "Thus, the rate of crimes using knives and means capable of causing damage similar to knives to commit crimes is very high, in which many cases are gangs and groups of organized subjects committing crimes with a very reckless nature. Many cases have caused public outrage, confusion and anxiety among the people," said delegate Le Nhat Thanh.
However, these cases can only be prosecuted criminally when there is sufficient evidence to conclude that the subject has committed other crimes. The subject cannot be prosecuted for illegal possession or use of weapons because current law does not define knives or knife-like devices as weapons.
"Therefore, it is necessary to define highly lethal knives as primitive weapons to promptly prevent dangerous behavior of subjects right from the stage of preparing to commit a crime or orienting the subject's behavior," delegate Le Nhat Thanh suggested.
Considering that adding high-damage knives to the group of primitive weapons is necessary, delegate Nguyen Van Thuan (Can Tho) explained that high-damage and dangerous knives produced, traded, and bought by businesses and people have not been strictly managed by authorities. Meanwhile, a person can easily buy or make high-damage knives for use, causing harm to human life and health, and causing insecurity and disorder.
Regarding this issue, Deputy Chairman of the National Assembly's Committee on National Defense and Security Nguyen Minh Duc said that further research is needed when developing the concept of weapons so that the Drafting Agency and the Reviewing Agency can calculate and develop the most standard concept that can cover all types of weapons that are dangerous and violate human life and health.
