A0 will be separated from Vietnam Electricity Group (EVN) to establish a company under the State Capital Management Committee.
NSMO is a state-owned enterprise in which the State holds 100% of the charter capital, and will be separated from EVN within a maximum of 7 days from August 1.
Separate A0 from EVN to establish a company
The National Electricity System and Electricity Market Operation Company Limited will continue to act as the national electricity system dispatching agency, operating electricity market transactions according to the provisions of the Electricity Law and related laws.
With a charter capital of 776 billion VND, the National Power System and Electricity Market Operation Company Limited receives the current status of the National Power System Dispatch Center's workforce from EVN. This includes receiving the current status of A0's management apparatus on the basis of continuing to arrange A0's leadership and management staff into corresponding leadership positions of NSMO.
The National Power System and Electricity Market Operation Company Limited inherits all rights, obligations and legal interests of the Power System Dispatch Center currently implemented by A0 and EVN related to A0 according to the provisions of law.
For the two loans under the agreement to build the new National Power System Dispatch Center project and the Information Infrastructure project for the competitive power generation market with a total capital of nearly 3 million USD, EVN continues to be responsible for repaying the loan to the authorized re-lending agency according to regulations.
The National Electricity System and Electricity Market Operation Company Limited is responsible for repaying to EVN the debt repayment to the authorized re-lending agency and performing related obligations.
At the same time, the Prime Minister issued a decision approving the policy of transferring the right to represent the ownership of state capital at the National Electricity System and Electricity Market Operation Company Limited from the State Capital Management Committee at Enterprises to the Ministry of Industry and Trade.
This will be done after completing the separation and establishment of the National Electricity System and Market Operation Company Limited according to regulations. The State Capital Management Committee and the Ministry of Industry and Trade are responsible for the content of the report, proposal; deciding and implementing the transfer of capital ownership representation rights.
The Ministry of Industry and Trade will prepare all necessary conditions to receive the National Electricity System and Electricity Market Operation Company Limited, including a mechanism to ensure working capital and stable, continuous and effective operation after the transfer.
There is a capital and salary mechanism.
The Ministry of Industry and Trade shall preside over and coordinate with relevant ministries and branches to promulgate, within its authority, or submit to competent authorities for promulgation, legal documents serving the operation of the National Electricity System and Market Operation Company Limited, ensuring that NSMO operates stably, continuously and effectively.
The National Power System and Electricity Market Operation Company Limited proactively studies, proposes, and forecasts difficulties and problems in the operation process, has specific proposals, and clearly states the authority to amend, supplement, and issue new legal documents and relevant instructions to serve the effective and safe operation of the power system.
Relevant ministries and branches propose and submit to competent authorities mechanisms to support investment capital arrangement for NSMO. Supplement charter capital for the National Electricity System and Electricity Market Operation Company Limited, guarantee or support loan mechanisms for projects implemented by the company, mechanisms for NSMO to access low-interest loans...
The Ministry of Labor, War Invalids and Social Affairs determines the salaries of employees and managers of NSMOs according to the prescribed salary mechanism. In which, NSMOs are temporarily ranked as grade I to serve as the basis for salary classification for managers.
This will be done until the Government issues a decree on labor management, wages, remuneration and bonuses for state-owned enterprises in the spirit of Resolution No. 27 on reforming salary policies for cadres, civil servants, public employees, armed forces and employees in enterprises.
EVN reviews and determines the detailed and specific legal rights, obligations and interests of A0 according to legal regulations as a basis for transfer when separating A0 from EVN and transferring it to the successor National Electricity System and Electricity Market Operation Company Limited.
