According to the investigation, at the end of 2020, the Investigation Police Agency of Hai Ba Trung District Police received a complaint from Vinschool LLC accusing Luu Thi Ngoc Hang and Nguyen Thu Hang of creating a fake list of bonuses for people who introduced employees to work at Vinschool Company to get money to spend.
The investigation determined that Thu Hang was a foreign personnel recruitment specialist, and Ngoc Hang was a Vietnamese personnel recruitment specialist at Vinshool LLC. Both were assigned to make a list of proposed bonuses according to the company's employee bonus policy. Accordingly, if a candidate is introduced to work, they will be rewarded from 3 to 15 million VND, depending on the position of the successful candidate. The process of making a bonus payment list is that Ngoc Hang makes a list including information about the referrer, the referred person, the recruited job position, and the bonus amount. Then, Ngoc Hang sends an email to the HR director for approval, then forwards it to the General Director for approval. Ngoc Hang forwards it to the accounting department to proceed with bonus payment.
Around mid-2019, Ngoc Hang discovered that there was a lack of transparency in the list approval process, so she had the intention to commit fraud. Ngoc Hang discussed with Thu Hang and asked to provide information about relatives and acquaintances to be included in the bonus list. When the list was approved, the defendants would contact relatives and acquaintances to say that the HR department had made a mistake in the salary and asked them to transfer the money back to their accounts.
Using the above tricks, from July 2019 to October 2020, Ngoc Hang and Thu Hang created fake bonus lists for 22 people in 4 bonus payment periods to appropriate more than 770 million VND. Vinschool LLC determined that the 22 cases receiving bonuses were not subject to the company's payment policy.
During the investigation, Ngoc Hang admitted to giving Thu Hang cash, but did not specify how much, and did not have any documents to prove it. Thu Hang did not admit to discussing with Ngoc Hang about receiving the company's bonus, and did not share or benefit from the embezzled money. Currently, Ngoc Hang has recovered 100 million VND for the company.
In addition, the investigation agency also received complaints from a number of individuals about Thu Hang receiving money to get them jobs at Vinshool LLC. However, because there were no documents proving the money transfer or agreement, the police had no basis to investigate.
The People's Court of Hanoi sentenced Luu Thi Ngoc Hang to 7 years in prison and Nguyen Thu Hang to 3 years in prison, both for the same crime.
