On November 27, while discussing in the hall to finalize the draft revised Law on the Capital, many National Assembly Deputies spent time analyzing regulations on applying administrative measures such as cutting off electricity and water to constructions that violate fire prevention and construction order.

Delegate Trang A Duong (Ha Giang delegation) proposed to consider including in the draft amended Law on the Capital the regulation on cutting off electricity and water for constructions and production and business establishments violating the fields of land, construction, and fire prevention and fighting that have been recorded as administrative violations or have been administratively sanctioned.

According to Mr. Duong, this is one of the controversial contents when building the Capital Law. “Electricity and water are essential needs of individuals. Applying this measure is a deep intervention in civil relations, so it needs to be considered and cautious to ensure the harmony of interests of all parties,” Mr. Duong said.

In addition, according to delegate Duong, this is an administrative legal relationship. Therefore, using civil measures to resolve administrative legal relationships is an inappropriate intervention in civil law relationships and also does not ensure humanity in many cases of application, affecting life, rights and interests.

“Therefore, I think that there should be no regulation to apply measures to stop providing electricity and water services at the location of the violation for construction works and production and business establishments that violate the fields of land, housing, construction and fire prevention and fighting,” Mr. Duong stated his opinion.

Regarding the same issue, delegate To Van Tam (Kon Tum delegation) said that electricity and water should only be cut off for certain violations and for establishments that have been fined or fined but continue to violate without correcting the violations.

“Based on the location and role of the capital, which concentrates a very large number of residents and tourists, the requirements for ensuring security, order, and social safety, including ensuring the security of health, property, and human life, are very high,” said Mr. To Van Tam.

Delegate Thach Phuoc Binh (Tra Vinh delegation) expressed concern that if electricity and water were cut off at violating production and business establishments, workers could be forced to work at other factories in the same area. This would cause overload in some areas, causing environmental pollution.

"In case of cutting off electricity and water to all production and business establishments, illegal electricity connections may arise, and the risk of fire and explosion will again exist," said a delegate from Tra Vinh delegation.

Explaining and accepting the opinions of delegates, Mr. Le Thanh Long - Minister of Justice said that preventive measures are not punitive measures. According to him, the draft law also localizes construction works and production and business establishments that violate the law.

“This measure is also relatively limited to specific areas, namely land, construction, fire prevention and fighting,” Minister of Justice Le Thanh Long added.
