The Ministry of Public Security has just issued Circular No. 73/2024/TT-BCA, effective from January 1, 2025, regulating the patrol, control, and handling of violations of laws on road traffic order and safety (TTATGT) by the traffic police (CSGT).

Traffic police in disguise will record illegal acts as a basis for punishment.

One of the notable new contents stated in Article 7 of this circular is the regulation on organizing forces to directly patrol and control openly combined with disguise on road traffic routes.

Accordingly, the Traffic Police team is assigned a group of officers in plain clothes and disguised vehicles to coordinate with the patrol and public control team according to the plan issued by the competent authority.

Cases of public patrol and control combined with disguise include: Using technical means and equipment to improve the effectiveness of ensuring traffic safety; fighting and preventing crimes; complicated security, order or road traffic safety situations.

Circular No. 73/2024 stipulates that the requirements for public patrol and control combined with disguise include the following contents:

Firstly, there must be a patrol and control plan issued by the competent authority according to regulations. The plan must clearly state the implementation method, forces, uniforms, communication methods, time, route, and area of ​​patrol and control.

Second, there must be professional technical equipment and means; weapons, support tools and other technical means used for patrolling and controlling.

Third, the disguised officers and the public patrol and control team in the traffic police team must maintain an appropriate distance to ensure timely and legal handling of violations.

Regarding the working process, Circular No. 73/2024 stipulates that undercover officers are responsible for directly observing and using professional means and equipment to monitor road traffic safety and order, detecting violations of traffic safety laws and other violations of law.

Situations when detecting crime

In cases where undercover officers discover serious violations of traffic safety, security, and social order, which if not promptly prevented will cause dangerous consequences for society, damage the property of agencies, organizations, individuals, and harm the lives and health of traffic participants.

At that time, the disguised traffic police used their police ID cards to request the vehicle to stop and notify and mobilize people to cooperate and immediately prevent violations.

When undercover traffic police detect violations, the public police force will coordinate to handle them.

At the same time, notify and coordinate with the patrol and public control staff to resolve the violation at the place where it is discovered or bring the violator to the nearest police station for resolution according to regulations.

This new Circular also stipulates that traffic police performing patrol and control duties according to plan are allowed to stop vehicles participating in road traffic for control according to the provisions of Article 65 and Article 66 of the Law on Road Traffic Safety.

Stopping and controlling vehicles must ensure the following requirements: Safety, compliance with legal regulations, and no obstruction to traffic activities; once a vehicle has been stopped, it is necessary to carry out control and handle violations (if any) according to regulations.
