The Ministry of Health is assigned to carry out state management of health conditions of drivers and specialized motorbike drivers; regulations on determining alcohol concentration and endogenous alcohol concentration in the blood.
Absolute prohibition of "inheritance"
Before the National Assembly passed the law, Chairman of the National Defense and Security Committee Le Tan Toi, on behalf of the National Assembly Standing Committee, reported and explained the opinions of National Assembly deputies. In which, it was clearly stated that many opinions agreed with the regulation on absolute prohibition of alcohol concentration.
However, some opinions suggested considering a regulation with a minimum threshold. Some other opinions suggested presenting two options to seek opinions from National Assembly deputies.
The National Assembly Standing Committee said that the above regulation is not new content but inherits the provisions of the 2008 Road Traffic Law and is consistent with the provisions of the 2019 Law on Prevention and Control of Harmful Effects of Alcohol and Beer and has specific regulations for the field of road traffic.
According to the National Assembly Standing Committee, if the regulation is not continued, there will be a risk of increasing violations of road traffic safety and order, road traffic accidents, leading to increased consequences and damage.
Along with that, it goes against the efforts of the entire political system, causing a waste of effort and money of the State and people in the past time.
According to the National Assembly Standing Committee, at the 6th session, the majority of National Assembly deputies agreed with this regulation and some National Assembly deputies proposed to set the lowest limit. Therefore, the General Secretary of the National Assembly asked for the opinions of National Assembly deputies by ballot, the result was that the majority agreed with this regulation to prohibit driving with alcohol concentration in blood or breath.
On this basis, the Standing Committee of the National Assembly proposed that the National Assembly continue to implement the prohibition.
Need to implement synchronous solutions

Speaking to Tuoi Tre after the National Assembly voted, delegate Tran Khanh Thu (Thai Binh) affirmed that the regulation prohibiting absolute alcohol concentration is not new but is inherited from other laws.
After the implementation of Decree 100, a traffic culture of "don't drive after drinking alcohol" has gradually formed. All are aimed at the goal of best protecting people's lives and health.
To date, according to her, this has been legalized in the Law on Road Traffic Safety and Order, creating consistency in the legal system.
"In order for the law to come into effect soon, the Government, the Ministry of Public Security and the agencies assigned tasks in the law must quickly complete and issue regulations within their authority to guide the implementation of the provisions," said Ms. Thu.
Meanwhile, delegate Nguyen Thi Viet Nga (Hai Duong) said that the regulation to absolutely ban alcohol concentration for drivers is necessary in the current conditions. In order for this regulation to be put into practice soon, especially after the law takes effect, Ms. Nga said that it is necessary to implement synchronous solutions.
In particular, it is necessary to strengthen regular and continuous propaganda work on this regulation with the participation of the entire political system. At the same time, it is not only aimed at propaganda but also at the goal of changing awareness, behavior, and a scientific, healthy lifestyle, without abusing alcoholic beverages and stimulants.
Along with that, strictly implement regulations to punish violations, no forbidden areas, no exceptions, no matter who.

Ministry of Health determines endogenous alcohol concentration
Regarding concerns about endogenous alcohol concentration, delegate Tran Khanh Thu said the new law has assigned the Ministry of Health to regulate the determination of alcohol concentration and endogenous alcohol concentration in the blood as a basis for determining cases of drivers whose blood contains alcohol due to the use of wine, beer or other alcoholic beverages.
Thus, when there are guidelines, it is necessary to increase propaganda so that people know how to apply and implement them.
