The Ministry of Construction has just sent a document to provinces and centrally run cities requesting them to strengthen the implementation of legal regulations on construction for individual houses.

In particular, violations of fire prevention and fighting regulations lead to a high risk of fire and explosion in the residential community, typically the recent fire at house number 37, alley 29/70, Khuong Ha street (Khuong Dinh ward, Thanh Xuan district, Hanoi), causing very serious damage to people and property.

The Ministry of Construction requires: For completed multi-storey, multi-apartment individual housing projects, it is necessary to urgently review all these projects to detect violations of construction order, especially violations of fire prevention and fighting. From there, there must be solutions to separate the parking area from the residential area and have separate escape routes; invest in appropriate fire prevention and fighting equipment; arrange for healthy and experienced people to manage and operate the building, and strictly handle violations of related organizations and individuals according to the provisions of law.

For the above-mentioned projects when newly constructed, local competent authorities must strictly control compliance with legal regulations on planning, construction, fire prevention and fighting, management of construction licensing, quality management, and construction order management according to regulations.

The Ministry of Construction also requested that competent authorities strengthen inspection and examination work to detect and strictly handle violations of construction order and fire prevention and fighting by relevant organizations and individuals.

In the document, the Ministry of Construction said that the law on housing has stipulated: individual houses are designed and built with two or more apartments in a closed style (with separate living rooms, separate kitchens, separate toilets and bathrooms), with a minimum floor area of ​​each apartment of 30 square meters or more and the construction, repair and renovation of these houses must comply with the provisions of the law on construction.

Specifically, the construction of individual houses of households and individuals must comply with the following regulations: If the construction of a house does not have a basement, has a total floor area of ​​less than 250 m2 or less than 3 floors or has a height of less than 12 m, the investor of the individual house construction is allowed to organize the design and construction of the project.

If building a house with less than 7 floors or 1 basement, the design must be carried out by an organization or individual with sufficient capacity according to the provisions of law.

If building a house with 7 floors or more or 2 basements or more, the design documents must be examined for construction safety before applying for a construction permit. The design and design examination must be carried out by organizations and individuals with sufficient capacity according to the provisions of law.

Thus, the law on construction and housing has created a legal corridor to fully regulate related activities in the field of construction works in general, and construction of individual houses in particular, including the type of individual houses designed with many floors and many households in urban areas, from granting construction permits, ensuring fire prevention and fighting safety, construction, quality management, ... as well as handling related violations ," the Ministry of Construction affirmed.

However, according to the Ministry of Construction, there has been a situation where households and individuals have taken advantage of the lax management of functional agencies to build multi-storey, multi-apartment houses or built houses with rooms for rent without complying with the provisions of the law on construction and fire prevention and fighting.

Specifically: construction not according to planning, construction without permission, construction without permission, construction of houses that do not meet fire prevention and fighting standards and regulations, arbitrarily designing and arranging houses into many apartments for the purpose of renting, buying, selling, transferring...

This has led to many consequences: increased population density; overloading of technical infrastructure, social infrastructure, and traffic infrastructure; failure to ensure environmental sanitation, affecting local security and order; disrupting planning; disputes and lawsuits between buyers and sellers due to failure to issue Certificates of Ownership...
