Ministry of Defense talks about proposal that school graduates must do military service before studying

The Ministry of National Defense has just responded to voters in Hung Yen province about the proposal to study and submit to the National Assembly to supplement the Law on Military Service, including the requirement that citizens of military age who pass the entrance exam to schools can reserve their results, but must complete their military service before continuing their studies.

The Ministry of National Defense continues to research and fully evaluate related policies and impacts, report and propose to the Government to amend and supplement the 2015 Law on Military Service.

According to the Ministry of National Defense, Point g, Clause 1, Article 41 of the 2015 Law on Military Service stipulates that citizens studying at general education institutions, or in full-time university or college training will be temporarily deferred from military service.

To ensure social justice, the military service age of citizens subject to the above-mentioned deferment is also extended so that citizens have the opportunity to fulfill their sacred duty to the Fatherland.

Therefore, Article 30 of the Law stipulates that citizens who are 18 years old can be called up for military service; the age for military service is from 18 to 25 years old; citizens who have received college or university degrees and have been temporarily deferred from military service, the age for military service is up to 27 years old.

At the same time, Point b, Clause 3, Article 50 of the Law on Military Service 2015 stipulates that, before joining the army, those who were studying or received a call to study at schools belonging to vocational education institutions or universities will have their results reserved and be accepted to study at those schools.

Thus, the above regulations have contributed to ensuring fairness in the performance of military service, meeting the legitimate aspirations of citizens' rights and legal interests to study and work in accordance with the law; at the same time, creating high-quality human resources, while ensuring sufficient quantity and quality of citizens joining the army.

According to voters' recommendations, the requirement that all citizens of military age who pass the entrance exams to schools have their results reserved, but must complete their military service and then return to continue their studies in the current period needs to be studied comprehensively, fully and thoroughly.

The Ministry of National Defense will continue to research and fully evaluate related policies and impacts, report and propose to the Government to amend and supplement the 2015 Law on Military Service at the appropriate time, when there is sufficient basis to ensure feasibility so that the law on military service can be implemented effectively, practically and strictly.
