The number and duration of active service as currently prescribed are the basis for units to have enough time to train and practice to ensure that non-commissioned officers and soldiers have solid political will and specialized military techniques and tactics.
In addition, it also ensures the skills to exploit and skillfully use modern weapons and equipment suitable for new combat methods. Along with that, it is to create a reserve resource of mobilization and high-quality grassroots cadres for agencies and localities after demobilization.
Thus, the Ministry of National Defense believes that if the number of citizens called for military service increases and the term of military service is reduced, citizens will have to be called for military service and discharged from the military in two batches every year, leading to difficulties and costs in terms of materials, budget, time, and affecting the implementation of other tasks of the locality and unit.
In particular, the selection and calling of citizens for military service in the second phase will coincide with the university and college admissions season, causing inconvenience and leading to many petitions related to the postponement of citizens' military service.
Reducing active duty time will not meet the requirements of the military's training, combat readiness and combat missions.
Economically, every year the State has to spend thousands of billions of dong more from the budget to select and call citizens to join the army, train, practice and implement regimes and policies.
Voters propose to amend Article 41 of the Law on Military Service
The Ministry of National Defense also received a petition from voters of Vinh Phuc province requesting to amend Article 41 of the 2015 Law on Military Service to limit shortcomings.
According to the content raised by voters, Article 41 of the law stipulates that citizens studying at general education institutions or receiving regular university or college training in a training course are temporarily deferred from military service.
However, cases of extension of study, retention, missed subjects, and re-examination of graduation have not been specifically regulated, leading to the situation of taking advantage to avoid military service, which is one of the difficulties when calling citizens to join the army for local authorities.
The Ministry of National Defense said that the process of implementing the Law on Military Service has revealed a number of difficulties and shortcomings.
Specifically, these are: Registration for military service, management of citizens of military age for students admitted to colleges and universities; some cases of extension of study, retention, missed subjects, re-examination of graduation or completion of studies without transferring to the new locality or place of residence for military service.
These cases do not have adequate regulations and sanctions, leading to exploitation to avoid military service, causing difficulties in local resource management and causing public outrage.
According to the Ministry of National Defense, in February 2022, the Prime Minister assigned the ministry to propose amendments and supplements to laws and decrees related to the Law on Military Service.
The Ministry of National Defense has established a steering committee and research team to propose the development of a draft law amending and supplementing a number of articles of the 2015 Law on Military Service, and to organize a review of 8 years of law implementation.
In response to voters' opinions, the Ministry of National Defense continues to research, report, and propose to the Government to amend and supplement the law at the appropriate time when there is a sufficient political, legal, and practical basis, ensuring scientific and feasible.
