On June 26, Minister of Home Affairs Pham Thi Thanh Tra signed and issued Circular No. 10/2023/TT-BNV guiding the implementation of basic salary levels for salary and allowance recipients in agencies, organizations, and public service units of the Party, State, Vietnam Fatherland Front, socio-political organizations, and associations.
Officials, civil servants and public employees who are being detained or imprisoned are subject to the new basic salary level.
The Circular clearly stipulates 9 groups of subjects of application, including: Cadres and civil servants receiving salaries from the state budget working in agencies of the Party, State, Vietnam Fatherland Front, socio-political organizations at the central level; in provinces and centrally run cities; in districts, towns, provincial cities, cities under centrally run cities; in special administrative-economic units.
Civil servants receive salaries from the salary fund of public service units according to the provisions of law (including the cases specified in Clause 19, Article 1 of the Law amending and supplementing a number of articles of the Law on Cadres, Civil Servants and the Law on Public Employees in 2019).
Officials, civil servants and public employees assigned by competent authorities to work at associations, non-governmental organizations, projects and international agencies and organizations located in Vietnam are still entitled to receive salaries according to the salary table issued with Decree No. 204/2004/ND-CP on salary regime for officials, civil servants, public employees and armed forces.
People working within the staffing quota assigned by competent authorities at associations assigned by the Party and the State will receive financial support from the state budget according to regulations in Decree No. 45/2010/ND-CP regulating the organization, operation and management of associations (amended and supplemented in Decree No. 33/2012/ND-CP).
Cadres, civil servants at communes, wards, and towns and part-time workers at commune level, in villages, and residential groups are prescribed in Decree No. 92/2009/ND-CP on titles, numbers, some regimes, and policies for cadres, civil servants at communes, wards, and towns and part-time workers at commune level (amended and supplemented in Decree No. 34/2019/ND-CP) and Decree No. 33/2023/ND-CP on cadres, civil servants at commune level and part-time workers at commune level, in villages, and residential groups. Accordingly, from July 1, 2023, the provisions of Decree No. 92/2009/ND-CP shall apply. From August 1, 2023, the provisions of Decree No. 33/2023/ND-CP shall apply.
People's Council delegates at all levels receive activity fees according to current law provisions.
People working in key organizations.
People who work under the labor contract regime prescribed in Decree No. 111/2022/ND-CP on contracts for certain types of work in administrative agencies and public service units are eligible or have an agreement in the labor contract to apply salary classification according to Decree No. 204/2004/ND-CP on salary regime for cadres, civil servants, public employees and armed forces.
The following subjects are subject to this Circular to calculate and determine the level of social insurance contributions and benefits and to resolve salary-related benefits according to the provisions of law: Cadres, civil servants, and public employees who are studying, interning, working, receiving treatment, or nursing care (domestic and foreign) on the payroll of Party and State agencies, socio-political organizations, public service units, and associations receiving state budget support for operating expenses. People who are in the probationary or probationary period (including commune-level civil servant probation) in Party and State agencies, socio-political organizations, public service units, and associations receiving state budget support for operating expenses. Cadres, civil servants, and public employees who are temporarily suspended from work, detained, or imprisoned.
How to calculate salary and allowances
Regarding the calculation of salary, allowances and operating fees, the Ministry of Home Affairs said that for cadres, civil servants, public employees and employees specified in Clauses 1, 2, 3, 4, 5, 8 and 9, based on the current salary and allowance coefficients prescribed in documents of competent agencies of the Party and State on salary regimes for cadres, civil servants, public employees and armed forces, the basic salary level prescribed in Decree No. 24/2023/ND-CP (prescribing basic salary levels for cadres, civil servants, public employees and armed forces) to calculate the salary level, allowance level and the amount of the reserved difference coefficient (if any).
In particular, the salary effective from July 1, 2023 will be equal to the basic salary (1.8 million VND/month) multiplied by the current salary coefficient. For example, for civil servants of type A1 with a starting salary coefficient of 2.34, the salary received is 4.212 million VND/month.
The allowance level for allowances calculated based on the basic salary will be equal to the basic salary multiplied by the current allowance coefficient. The allowance level for allowances calculated as a percentage of the current salary plus the leadership position allowance and the seniority allowance exceeding the framework (if any) will be equal to the total salary, the leadership position allowance, the seniority allowance exceeding the framework implemented from July 1, 2023 multiplied by the prescribed percentage. Allowances specified in a specific amount of money will remain the same according to current regulations. The amount of the reserved difference coefficient (if any) is equal to the basic salary multiplied by the currently enjoyed reserved difference coefficient (if any).
For People's Council delegates at all levels, the activity fee coefficient is used to calculate the activity fee level according to the formula: Basic salary of 1.8 million VND/month multiplied by the activity fee coefficient according to regulations.
For part-time workers at the commune, village and residential group levels, from July 1, 2023, the allowance fund allocated by the state budget for each commune, village and residential group as prescribed in Clause 5 and Clause 6, Article 2 of Decree No. 34/2019/ND-CP is calculated based on the basic salary of VND 1.8 million/month. The specific regulations on allowance levels for these subjects are implemented according to the provisions in Clause 5 and Clause 6, Article 2 of Decree No. 34/2019/ND-CP.
From August 1, 2023, the allowance fund allocated by the state budget for each commune level, each village and residential group as prescribed in Clause 1 and Clause 2, Article 34 of Decree No. 33/2023/ND-CP will be calculated based on the basic salary of VND 1.8 million/month. The specific regulations on allowance levels for these subjects shall be implemented according to the provisions in Clause 1 and Clause 2, Article 34 of Decree No. 33/2023/ND-CP.
For those working in key organizations under the management of the Ministry of National Defense and the Ministry of Public Security, follow the instructions of the Minister of National Defense and the Minister of Public Security. Those working in key organizations in Party, State agencies, and socio-political organizations (not under the management of the Ministry of National Defense and the Ministry of Public Security), calculate the salary, allowances, and reserve difference coefficient (if any) according to the above calculation.
The Circular takes effect from July 1, 2023, replacing Circular No. 04/2019/TT-BNV. Deductions and benefits calculated based on the basic salary will be recalculated accordingly from July 1, 2023.
