Ministry of Industry and Trade proposes to cut many administrative procedures related to the field of industrial explosives

The Ministry of Industry and Trade has just issued Official Dispatch No. 6613/BCT-PC to the Government Office; Ministries, ministerial-level agencies; Central Administrative Procedure Reform Advisory Council; Vietnam Federation of Commerce and Industry requesting comments on the draft Plan to reduce and simplify regulations related to business activities of the Ministry of Industry and Trade in 2025.

Accordingly, in Draft 2, Decision Approving the Plan to reduce and simplify regulations related to business activities under the management scope and functions of the Ministry of Industry and Trade in 2025, the Ministry of Industry and Trade proposed a plan to reduce administrative procedures related to many sectors and fields of operation. In particular, in the industrial explosives sector alone, 4 administrative procedures were proposed to be reduced and simplified.

Specifically, administrative procedure 1 is the procedure for Issuing a Certificate of eligibility for the production of explosive precursors used to produce industrial explosives (TTHC code: 1.000998). In which, the content of the reduction and simplification is: Reducing the administrative procedure for Issuing a Certificate of eligibility for the production of explosive precursors used to produce industrial explosives (TTHC code: 1.000998). The reason is the decentralization of the authority to handle administrative procedures from the Ministry of Industry and Trade to the Department of Industry and Trade according to the content of Decision No. 1015/QD-TT dated August 30, 2022 approving the Decentralization Plan in handling administrative procedures under the management of ministries and ministerial-level agencies.

The Ministry of Industry and Trade recommends: Amending and supplementing Article 18 of Decree No. 71/2018/ND-CP dated May 15, 2018 of the Government detailing a number of articles of the Law on Management and Use of Weapons, Explosives and Supporting Tools on Industrial Explosives and Explosive Precursors; Amending and supplementing Point a, Clause 1, Clause 3, Article 6 of Circular No. 13/2018/TT-BCT dated June 15, 2018 of the Ministry of Industry and Trade regulating the management and use of industrial explosives and explosive precursors used to produce industrial explosives. The implementation roadmap is 2025.

Administrative procedure 2 is the procedure for Issuing and adjusting the Certificate of eligibility for the production of explosive precursors used to produce industrial explosives (TTHC code: 1.000965). The content of the reduction and simplification is to reduce the administrative procedure for Issuing and adjusting the Certificate of eligibility for the production of explosive precursors used to produce industrial explosives. The reason is the decentralization of the authority to handle administrative procedures from the Ministry of Industry and Trade to the Department of Industry and Trade according to the content of Decision No. 1015/QD-TTg dated August 30, 2022 approving the Decentralization Plan in handling administrative procedures under the management of ministries and ministerial-level agencies.

Administrative procedure 3, granting of License for export and import of explosive precursors used to produce industrial explosives (TTHC code: 2.000578). The content of the reduction and simplification is to reduce the granting of License for export and import of explosive precursors used to produce industrial explosives. The reason is due to changes in the group of chemicals that need to be managed according to the draft Law on Chemicals (amended).

The Ministry of Industry and Trade recommends abolishing regulations on procedures related to chemicals with restricted production and trading, table chemicals, industrial precursors, and explosive precursors stipulated in the Law on Chemicals, Decree No. 113/2017/ND-CP dated October 9, 2017 of the Government detailing and guiding the implementation of a number of articles of the Law on Chemicals, Decree No. 33/2024/ND-CP dated March 27, 2024 stipulating the implementation of the Convention on the Prohibition of the Development, Production, Stockpiling, Use and Destruction of Chemical Weapons. The implementation roadmap is in accordance with the progress of the amended Law on Chemicals (the amended Law on Chemicals is expected to take effect in 2026).

Administrative procedure 4 is the issuance of a Business License for explosive precursors used to produce industrial explosives (TTHC code: 1.000917). The content is reduced and simplified: Reduction of the issuance of a Business License for explosive precursors used to produce industrial explosives. The reason is that there is a change in the group of chemicals that need to be managed according to the draft Law on Chemicals (amended).

The Ministry of Industry and Trade recommends abolishing regulations on procedures related to chemicals with restricted production and trading, table chemicals, industrial precursors, and explosive precursors stipulated in the Law on Chemicals, Decree No. 113/2017/ND-CP dated October 9, 2017 of the Government detailing and guiding the implementation of a number of articles of the Law on Chemicals, Decree No. 33/2024/ND-CP dated March 27, 2024 regulating the implementation of the Convention on the Prohibition of the Development, Production, Stockpiling, Use and Destruction of Chemical Weapons. The implementation roadmap is in accordance with the progress of the amended Law on Chemicals (the amended Law on Chemicals is expected to take effect in 2026).
