Deputy Minister of Industry and Trade Truong Thanh Hoai has just signed and issued Circular No. 14/2025/TT-BCT, stipulating the method of preparation, dossiers, order and procedures for approving electricity transmission service prices; guidance methods and forms of pricing for transmission grids invested in and built by non-state economic sectors as prescribed in Points a and b, Clause 6, Article 51 of Electricity Law No. 61/2024/QH15.
This Circular shall apply to Vietnam Electricity Group, power transmission units, power trading companies, Power Corporations and customers purchasing electricity directly from the power transmission grid.
Article 3 of this Circular stipulates the principles and methods for determining the price of electricity transmission services. Accordingly, the price of electricity transmission services is determined annually based on reasonable and valid expenses for the electricity transmission activities of the electricity transmission unit with a reasonable profit level.
The price of electricity transmission services is adjusted according to actual fluctuations in input parameters including: foreign exchange rates, loan interest rates, transmitted electricity output, fixed asset depreciation costs, taxes, fees, and other amounts payable to the State or in the event of incidents, disasters, or force majeure events as prescribed by law on emergency situations and relevant legal provisions that cause fluctuations in electricity transmission operating costs.
When the electricity transmission service price is updated according to actual fluctuations in the above input parameters (other parameters remain unchanged) or in case of incidents, disasters, or force majeure events changing by ±1% or more compared to the electricity transmission service price of the year approved for application, the electricity transmission service price will be considered for adjustment according to the order and procedures prescribed in Article 10 of this Circular.
Article 8 of the Circular stipulates the procedures for approving electricity transmission service prices. Accordingly, the Circular stipulates that before November 20 every year (year N-1), the electricity transmission unit is responsible for establishing the electricity transmission service price for year N, submitting it to the state management agency of electricity for appraisal and submitting it to the Minister of Industry and Trade for approval of the electricity transmission service price for year N.
The state management agency of electricity is responsible for reviewing the dossier of electricity transmission service price within 7 working days from the date of receipt of the dossier from the electricity transmission unit. In case the dossier of electricity transmission service price is not complete and valid according to the provisions of Article 9 of this Circular, the electricity transmission unit is responsible for completing and supplementing it within 5 working days from the date of receipt of the request of the state management agency of electricity.
In addition, the state electricity management agency shall send the electricity transmission service price dossier for year N to seek comments from relevant agencies and units (if any). Relevant agencies and units shall be responsible for sending comments within 5 working days from the date of receipt of the request from the state electricity management agency.
Within 25 days from the date the power transmission unit provides a complete and valid dossier as prescribed in Article 9 of this Circular, the state management agency of electricity shall be responsible for appraising the dossier of electricity transmission service prices and shall use consultants to appraise the dossier of electricity transmission service prices if necessary, and submit it to the Minister of Industry and Trade for approval of the electricity transmission service price for year N. Within 7 working days from the date the state management agency of electricity submits, the Minister of Industry and Trade shall approve the electricity transmission service price.
During the time when the electricity transmission service price for year N has not been approved, the parties shall agree on provisional payment in the electricity transmission service contract until the electricity transmission service price for year N is approved. The provisional payment shall be equal to the electricity transmission service price for year N-1. The difference between the provisional payment and the payment according to the electricity transmission service price of the year shall be settled by the parties after the electricity transmission service price for year N is approved.
