Ministry of Public Security proposes equipping 'special subject interrogation chairs'

The Ministry of Public Security has just posted the draft law on amending and supplementing a number of articles of the Law on Management and Use of Weapons, Explosives and Supporting Tools.

What is a "special subject interrogation chair"?

According to the Ministry of Public Security, recently, interrogation and recording of statements from thugs, aggressive, reckless, reckless subjects, strongly agitated subjects, and drug users leading to "stoned" have encountered many difficulties, causing danger to investigators and investigation officers.

To overcome this situation, the Ministry of Public Security has assigned a functional unit to research and produce a device called "interrogation chair for special subjects". This product is used to control and reduce the resistance of dangerous or especially dangerous subjects, ensuring the safety of the task force during the interrogation process.

Along with that, the Minister of Public Security issued a circular on the basic standards of the Ministry of Public Security for special subject interrogation chairs.

Police take statements from suspects in a drug case

Through evaluation, the special subject interrogation chair is very effective in controlling subjects, especially thugs, aggressive, reckless, reckless subjects; strongly agitated subjects, drug users leading to "stoned" can be dangerous for investigators and investigation officers during the interrogation and taking of statements.

This chair also helps prevent suicide and escape; deters and educates prisoners when they violate prison regulations; prevents negative behaviors of prisoners, especially in cases of stubborn prisoners, opposition, attacks on officers during work, and prisoners showing signs of mental instability.

Need legal basis for implementation

The Ministry of Public Security assessed that equipping special interrogation chairs for police units and localities is necessary, however, this has a certain impact on human rights, while there is no solid legal basis for its use and no instructions for use in each specific case.

Therefore, to ensure strictness in the process of use, the Ministry of Public Security believes that it is necessary to add special subject interrogation chairs to the concept of support tools in the Law on Management and Use of Weapons, Explosives and Support Tools.

According to the Ministry of Public Security, the negative side of the above proposal is that it will incur costs for amending, supplementing or issuing new documents to adjust policies; state management agencies will lose human resources and time to carry out registration, management and licensing of special interrogation chairs.

In return, the positive aspects include: creating a legal corridor for functional forces in the process of management and use to serve the fight against crime; no establishment of staff or organization to register and grant licenses for special interrogation chairs; no change in regulations on administrative procedures related to registration and management of support tools.

This also helps to manage and use closely, serving the investigation agencies in the process of taking statements and questioning dangerous and especially dangerous subjects to control and reduce the subjects' resistance, ensuring the safety of the task force.

Proposal to allow giving, donating, and providing aid in weapons and support tools

The Ministry of Public Security said that in reality, many organizations and businesses from other countries are currently donating, donating, and providing weapons and support tools to Vietnamese agencies, organizations, and units to serve research, production, and equipment use.

In addition, some organizations and individuals have the need to buy, sell, exchange, donate, or present scrap and waste weapons and support tools that are no longer recoverable, have no features or uses, and use them as display and exhibition objects.

However, the Law on Management and Use of Weapons, Explosives and Supporting Tools strictly prohibits the exchange, donation, giving, sending, borrowing, lending, renting, leasing, and mortgaging of weapons, explosives, supporting tools, scrap, and waste of weapons and supporting tools.

In order to take advantage of foreign resources to support Vietnam in researching, producing, equipping, and using weapons, explosives, and support tools, as well as creating a legal basis for organizations and individuals to use scrap and waste of weapons and support tools as exhibits, the Ministry of Public Security believes that it is necessary to study, amend, and supplement the provisions in Clauses 7 and 10, Article 5 of the Law on Management and Use of Weapons, Explosives, and Support Tools to suit reality.
